บันทึกฉบับนี้ จัดทำขึ้นระหว่างบริษัทโตโยต้า ริช จำกัด ตั้งอยู่เลขที่ 28 ถนนเชียงใหม่ – ลำปาง อำเภอเมือง จังหวัดเชียงใหม่ ซึ่งต่อไปนี้ในบันทึกเรียกว่า “ผู้ให้บริการ” กับ Mr. Eric Joseph Gershon เจ้าของรถยนต์ โตโยต้า YARIS รุ่น NSP152R-AHXRKT/D1 หมายเลขตัวถัง MR2K39F3401079522 หมายเลขเครื่องยนต์ 3NR-S080591 ออกรถยนต์ใหม่เมื่อวันที่ 12 มิถุนายน 2558 ซึ่งต่อไปนี้เรียกว่า “ลูกค้า”
เพื่อเป็นการให้บริการลูกค้าเป็นกรณีพิเศษ ตลอดจนเพื่อสร้างความพึงพอใจสูงสุดให้กับลูกค้า ทั้ง 2 ฝ่าย ได้ตกลงจัดทำบันทึกข้อตกลงต่อกัน โดยมีรายละเอียดดังนี้

1. ลูกค้ารับทราบ และยอมรับการดำเนินการของบริษัท ฯ คือ วันที่ 11/08/2558 ลูกค้าได้มารับแคชเชียร์เช็ค ธนาคารไทยพาณิชย์ สาขาประตูช้างเผือก เลขที่เช็ค .......................... สั่งจ่ายให้ Mr. Eric Joseph Gershon เป็นจำนวนเงิน 510,000 บาท (ห้าแสนหนึ่งหมื่นบาทถ้วน)
2. ลูกค้ารับทราบ และเข้าใจดีแล้วว่า การให้บริการเป็นกรณีพิเศษในครั้งนี้ ของผู้แทนจำหน่ายนั้น เพื่อเป็นการสร้างความพึงพอใจสูงสุดให้กับลูกค้า รถ TOYOTA YARI สีแดง หมายเลขตัวถัง MR2K39F3401079522 สามารถใช้งานได้ดีเป็นปกติทุกอย่างไม่มีส่วนหนี่งส่วนใดของผลิตภัณฑ์บกพร่อง
3. ลูกค้ารับทราบ และเข้าใจดีแล้วว่า การให้บริการเป็นกรณีพิเศษนี้ เป็นข้อยกเว้นของการรับประกันคุณภาพรถยนต์ และการบำรุงรักษารถยนต์ การดำเนินการตามบันทึกข้อตกลงฉบับนี้ โดยบริษัท ฯได้พิจารณาเป็นกรณีพิเศษสำหรับลูกค้าเท่านั้น ลูกค้าตกลงที่จะไม่เปิดเผยหรือเผยแพร่ข้อความส่วนหนึ่งส่วนใด ของบันทึกข้อตกลงฉบับนี้ ไม่ว่ากรณีใด ๆ ทั้งสิ้น
4. ลูกค้ายอมสละสิทธิที่จะไม่เป็นเจ้าของรถหมายเลขตัวถัง MR2K39F3401079522 นับตั้งแต่วันที่ 11 สิงหาคม 2558

ทั้งนี้ ลูกค้า ได้รับทราบ และจะปฏิบัติตามบันทึกข้อตกลงนี้เพื่อยุติเรื่องดังกล่าว และไม่ติดใจในเรื่องที่ได้แจ้งกับ ทางบริษัท ฯ อีกต่อไป โดยลูกค้าได้อ่านและเข้าใจในเนื้อหาตามบันทึกโดยตลอดแล้ว จึงได้ลงลายมือชื่อไว้เป็นหลักฐาน
