กฎหมายแพ่งเกี่ยวกับความสามารถของผู้เยาว์

ผู้เยาว์ คือ บุคคลซึ่งยังไม่บรรลุนิติภาวะ การสิ้นสุดผู้เยาว์สิ้นสุดเมื่อ

1. อายุครบ 20 ปีบริบูรณ์

2. สมรสตามกฎหมาย

กิจการที่ผู้เยาว์สามารถทำได้ และก่อให้เกิดผลทางกฎหมายแบ่งเป็น 2 ประเภท คือ

1. นิติกรรม คือ กิจการใด ๆ ที่บุคคลกระทำโดยชอบด้วยกฎหมาย

2. นิติเหตุ คือ เหตุการณ์ใด ๆ ที่นอกเหนือจากนิติกรรม เกิดได้ 2 ทาง คือ

2.1 เกิดโดยธรรมชาติ

2.2 เกิดจากการกระทำของบุคคล

ด้านทรัพย์สินของผู้เยาว์

- ผู้แทนโดยชอบธรรมของผู้เยาว์ สามารถจัดการกับทรัพย์สินของผู้เยาว์ได้โดยลำพังตามที่เห็นสมควรและประโยชน์ของผู้เยาว์

- ผู้แทนโดยชอบทำของผู้เยาว์ ไม่สามารถทำหนี้ ทำหนี้โดยที่ผู้เยาว์จะต้องทำเองโดยไม่ได้รับความยินยอมจากผู้เยาว์ไม่ได้

การทำนิติกรรมใด ๆ ของผู้เยาว์ หากปราศจากการยินยอมของผู้แทนโดยชอบธรรมจะถือว่าเป็นโมฆียะทั้งสิ้น แต่มีข้อยกเว้นในบางกรณี ได้แก่

1. การทำนิติกรรมที่เป็นประโยชน์แก่ผู้เยาว์ฝ่ายเดียว

2. การทำนิติกรรมที่ผู้เยาว์ต้องทำเองเฉพาะตัว

3. การทำนิติกรรมเพื่อดำรงชีพของผู้เยาว์
