ช่วงสองปีที่ผ่านมามหาวิทยาลัยหลายๆ แห่งรณรงค์ให้รัฐบาลเร่งเอาจริงเอาจังหรือออกมาตรการควบคุมการบริโภคเครื่องดื่มแอลกอฮอล์ของเยาวชนไทย โดยเฉพาะการควบคุมดูแลไม่ให้มีการเปิดร้านเหล้าใกล้บริเวณสถานศึกษาโดยได้มีการยื่นเรื่องต่อกรมสรรพสามิตให้ยกเลิกใบอนุญาตจำหน่ายสุราแก่ร้านเหล้าต่าง ๆ ที่อยู่บริเวณรอบรั้วมหาวิทยาลัย เนื่องจากการสำรวจของเครือข่ายศูนย์กิจกรรมเยาวชนเพื่อชุมชนและสังคม บริเวณรอบมหาวิทยาลัยจำนวน 11 แห่ง พบว่ามีสถานที่ขายเครื่องดื่มแอลกอฮอล์ตั้งอยู่บริเวณเดียวกับสถานศึกษาในระยะ 500 เมตรแทบทุกมหาวิทยาลัย จำนวนถึง 335 ร้าน!! และมีป้ายโฆษณาเครื่องดื่มแอลกอฮอล์ 128 ป้าย!!

คุณผู้อ่านก็ลองนึกดูนะครับว่าเมื่อมีร้านขายเหล้ารายรอบมหาวิทยาลัยได้ขนาดนี้ เด็กและเยาวชนจะยืนมองเฉยๆ เหรอครับ ซึ่งความพยายามของหลายฝ่ายในการดูแลเยาวชนของชาติก็ใช่ว่าจะไม่มีผลเพราะมีการผลักดันออกกฎหมายจนกลายเป็น พ.ร.บ.ควบคุมเครื่องดื่มแอลกอฮอล์ พ.ศ. 2551 ที่มีผลบังคับใช้ตั้งแต่วันที่ 14 กุมภาพันธ์ 2551 เพื่อป้องกันไม่ให้เยาวชนตกเป็นทาสของเครื่องดื่มแอลกอฮอล์ โดยมาตรา 29 ของ พ.ร.บ.ฉบับนี้ห้ามขายเครื่องดื่มแอลกอฮอล์ให้กับเด็กอายุต่ำกว่า 20 ปีหรือบุคคลที่มีอาการมึนเมาจนครองสติไม่ได้ และกำหนดโทษผู้กระทำความผิดมีโทษจำคุกไม่เกิน 1 ปี ปรับไม่เกิน 20,000 บาท หรือทั้งจำทั้งปรับ

นอกจากนี้ พ.ร.บ.คุ้มครองเด็กฯ พ.ศ. 2546 ยังระบุว่าหากบุคคลใดขาย แลกเปลี่ยนหรือให้สุราหรือบุหรี่แก่เด็กอายุต่ำกว่า 18 ปี เว้นแต่การปฏิบัติทางการแพทย์มีโทษ จำคุกไม่เกิน 3 เดือนหรือปรับไม่เกิน 30,000 บาท หรือทั้งจำทั้งปรับเลยนะครับ

ขายเหล้าปั่น...ก็ต้องขอใบอนุญาต

กรณีที่ร้านเหล้าร้านใดได้รับใบอนุญาตขายสุราจากเจ้าหน้าที่สรรพสามิตแล้ว ก็ใช่ว่าจะสามารถขายเหล้าปั่นได้เลยทันทีนะครับ เพราะการขายเหล้าปั่นถือเป็นการเปลี่ยนแปลงน้ำสุราตามมาตรา 23 ของพระราชบัญญัติสุรา พ.ศ. 2493 จะขายได้ก็ต่อเมื่อผู้ซื้อได้ร้องขอให้ทำการเปลี่ยนแปลงสุราเพื่อดื่มในขณะนั้น หากขายสุราที่เปลี่ยนแปลงโดยที่ผู้ซื้อมิได้ร้องขอเพื่อดื่มในขณะนั้น มีโทษปรับไม่เกิน 500 บาท
