ตามกฎหมายว่าด้วยการส่งเสริมการลงทุน

การที่ผู้ลงทุนต่างชาติที่ได้ลงทุนพัฒนาโครงการต่างๆ ใน สปป. ลาวจะขอให้ได้มาซึ่งสิทธินำใช้ที่ดินจากรัฐบาลแห่ง สปป. ลาวนั้นมีเงื่อนไขดังต่อไปนี้

1. โครงการของผู้ลงทุนต่างชาติต้องมีทุนจดทะเบียนตั้งแต่ 500,000 ดอลล่าร์สหรัฐขึ้นไป โดยต้องมีการรับรองมูลค่าที่นำเข้าของทุนจดทะเบียนจำนวนดังกล่าวจากธนาคารแห่ง สปป. ลาว

2. ผู้ลงทุนต่างชาติจะมีสิทธิในการนำใช้ที่ดินจากรัฐที่ได้มีการกำหนดจัดสรรๆ ไว้แล้วเท่านั้น และการนำใช้ที่ดินดังกล่าวจะทำได้ไม่เกิน 800 ตารางเมตร

3. ผู้ลงทุนต่างชาติต้องใช้ที่ดินดังกล่าวเพื่อวัตถุประสงค์ในการปลูกสร้างเป็นที่อยู่อาศัย หรือใช้เป็นสำนักงานในการดำเนินธุรกิจของตนเท่านั้น และ

4. ผู้ลงทุนต่างชาติจะได้รับอนุญาตให้มีการซื้อสิทธิการใช้ที่ดินจากรัฐได้เพียงครั้งเดียวต่อหนึ่งนิติบุคคลของตนเท่านั้น โดยไม่คำนึงถึงว่านิติบุคคลดังกล่าวจะมีสาขาอยู่ใน สปป. ลาวมากหรือน้อยเพียงใด

ทั้งนี้ องค์กรคุ้มครองที่ดินของท้องถิ่นที่นิติบุคคลดังกล่าวตั้งอยู่จะเป็นผู้พิจารณา และอนุญาตให้สิทธินำใช้ที่ดินแก่ผู้ลงทุนต่างชาติได้ โดยจะออกเป็นใบตาดิน (หรือโฉนด) ให้แก่ผู้ลงทุนต่างชาติซึ่งในใบตาดินดังกล่าวจะกำหนดชื่อบุคคล หรือนิติบุคคล และกำหนดอายุสิทธิการใช้ที่ดินไว้ในใบตาดินดังกล่าวด้วย
