กรมจัดหางาน ส่งเสริมให้ภาคเอกชนเข้ามาดำเนินการโดยมีเกณฑ์ตามพระราชบัญญัติจัดหางานและคุ้มครองคนหางาน พ.ศ. 2528 ภายใตัการควบคุม กำกับ ดูแลชองกรมการจัดหางาน ซึ่งผู้ประสงค์จะต้องขออนุญาตจัดตั้งสำนักงานจัดหางานหรือบริษัทจัดหางานจะต้องยื่นคำขอรับใบอนุญาตจัดหางานให้คนหางานทำงานในประเทศ รายละเอียดดังนี้
คุณสมบัติของผู้ยื่นคำขอ (ข้อมูลเฉพาะ ผู้ขอเป็นนิติบุคคล ที่ตั้งตามกฎหมายไทย)
1. ไม่เป็นกรรมการ หุ้นส่วน หรือผู้จัดการของนิติบุคคลซึ่งเป็นผู้รับอนุญาตจัดหางานอื่น
2. ไม่เป็นกรรมการ หุ้นส่วน หรือผู้จัดการของนิติบุคคลซึ่งถูกเพิกถอนใบอนุญาตจัดหางาน หรืออยู่ระหว่างใช้สิทธิอุธรณ์คำสั่งเพิกถอนใบอนุญาตจัดหางาน
3. มีหลักประกันเป็นจำนวนเงินตามที่กำหนดในกฎกระทรวง แต่ต้องไม่นน้อยกว่าหนึ่งแสนบาท วางไว้ักับนายทะเบียน เพื่อเป็นหลักประกันการปฎบัติตามพระราชบัญญัตินี้ในกรณีที่ผู้ขออนุญาตจัดหางานดังกล่าวเป็นนิติบุคคล นิติบุคคลนั้นต้องมีสัญชาติไทยและมีผู้จัดการ(ผู้รับอนุญาต) ต้องเป็นคนไทย และเป็นหนึ่งในกรรมการผู้มีสิทธิ์าลงนามผูกพันบริษัทด้วย
