รัฐธรรมนูญปัจจุบันซึ่งแก้ไขล่าสุดเมื่อ 1 มกราคม พ.ศ. 2527 กำหนดให้สุลต่านทรงเป็นอธิปัตย์ คือเป็นทั้งประมุข นายกรัฐมนตรี และรัฐมนตรีว่าการกระทรวงกลาโหม นายกรัฐมนตรีจะต้องเป็นชาวบรูไนเชื้อสายมาเลย์โดยกำเนิด และจะต้องเป็นมุสลิมนิกายสุหนี่ นอกจากนี้ บรูไนไม่มีสภาที่ได้รับเลือกจากประชาชน
