การคุ้มครองช้างนั้น ได้มีการคุ้มครองอยู่ 2 อย่าง คือ ช้างป่า เป็นสัตว์ป่าคุ้มครองอยู่ภายใต้การควบคุมของพระราชบัญญัติสงวนและคุ้มครองสัตว์ป่า พ.ศ. 2535 ส่วนช้างบ้านนั้น จัดเป็นสัตว์พาหนะ อยู่ภายใต้การควบคุมของพระราชบัญญัติสัตว์พาหนะ พ.ศ. 2482 ขณะเดียวกันช้างทุกชนิด ถูกจัดอยู่ในบัญชี 1 (Appendix I) ของอนุสัญญาว่าด้วยการค้าระหว่างประเทศ ซึ่งชนิดสัตว์ป่า และพืชป่าที่ใกล้สูญพันธุ์ (CITES) ที่ไม่อนุญาตให้มีการค้าระหว่างประเทศ และไม่อนุญาตให้มีการนำเข้า-ส่งออกงาช้างตามพระราชบัญญัติสงวนและคุ้มครองสัตว์ป่า พ.ศ.2534 (งาช้าง ที่ได้จากช้างบ้านสามารถค้าขายได้ภายในประเทศเท่านั้น ส่วนงาช้างแอฟริกา ไม่สามารถนำมาค้าขายภายในประเทศได้)
