ประการที่สอง ตามพระราชบัญญัติฉบับนี้ จะแบ่งการศึกษาเป็น 2 ระดับ คือ
1. ระดับการศึกษาขั้นพื้นฐาน ซึ่งต้องจัดอย่าง 12 ปี ซึ่งรวมถึงการศึกษาปฐมวัย ประถมศึกษา
และมัธยมศึกษา
2. ระดับการศึกษาอุดมศึกษา หรือหลังการศึกษาขั้นพื้นฐานซึ่งจะแบ่งออกเป็นระดับต่ำกว่า
ปริญญา และปริญญา
ส่วนประเภทการศึกษานั้นยังคงเปิดกว้างไว้ เช่น อาชีวศึกษา เป็นต้น
สำหรับการศึกษาผู้ใหญ่ และการศึกษาต่อเนื่อง (Continuing Education) ให้ถือว่าเป็น
ส่วนหนึ่งของระบบการศึกษาตลอดชีวิต
