กรณีบุตรที่เกิดนอกประเทศไทย
1) ถ้าบิดาเป็นผู้มีสัญชาติไทย และมารดาสัญชาติไทย จะจดทะเบียนสมรสกันหรือไม่ก็ตาม บุตรย่อมได้สัญชาติไทย
2) ถ้าบิดาเป็นผู้มีสัญชาติไทย และมารดาเป็นคนสัญชาติอื่น บิดาต้องจดทะเบียนสมรสกับมารดา บุตรจึงจะได้สัญชาติไทยตามบิดา ซึ่งการจดทะเบียนสมรสนั้นจะจดตามกฎหมายของต่างประเทศหรือจดทะเบียนสมรสที่สถานเอกอัครราชทูตไทยก็ได้
3) ถ้ามารดาเป็นผู้มีสัญชาติไทย และบิดาเป็นคนสัญชาติอื่น บิดาจะจดทะเบียนสมรสกับมารดาหรือไม่ก็ตาม บุตรย่อมได้สัญชาติไทยตามมารดา
- กรณีที่บุตรเกิดก่อนวันที่ 26 กุมภาพันธ์ 2535 (ค.ศ. 1992) โดยมีมารดาสัญชาติไทย บุคคลนั้นจะได้สัญชาติไทยโดยการเกิด โดยมีผลย้อนหลังไปตั้งแต่วันที่เกิด ซึ่งเป็นไปตามมาตรา 10 แห่ง พ.ร.บ.สัญชาติ พ.ศ. 2535
