การดำเนินงานด้านการป้องกันและปราบปรามการค้ามนุษย์



ประเทศไทยหยิบยกปัญหาการค้ามนุษย์เป็นวาระแห่งชาติที่ต้องแก้ไขอย่างเร่งด่วนและจริงจังตั้งแต่ปี พ.ศ.๒๕๔๗ โดยมี พ.ร.บ. ป้องกันและปราบปรามการค้ามนุษย์ พ.ศ. ๒๕๕๑ (The Anti-Trafficking in Persons Act 2008) และกำหนดนโยบาย ยุทธศาสตร์ และมาตรการในการป้องกันและปราบปรามการค้ามนุษย์ (พ.ศ. ๒๕๕๔-๒๕๕๙) ที่ให้ความสำคัญ ๕ ด้าน คือ การป้องกัน การดำเนินคดี การคุ้มครองช่วยเหลือ การพัฒนากลไกเชิงนโยบายและการขับเคลื่อน การพัฒนาและการบริหารข้อมูล

๑ กลไกการดำเนินงานในประเทศไทย

กลไกการดำเนินงานเพื่อป้องกันและปราบปรามการค้ามนุษย์ประกอบด้วย คณะกรรมการระดับชาติ ๒ คณะ ได้แก่ (๑) คณะกรรมการป้องกันและปรามปรามการค้ามนุษย์ (ปคม.) ซึ่งนายกรัฐมนตรีเป็นประธาน และ (๒) คณะกรรมการประสานและกำกับการดำเนินงานป้องกันและปราบปรามการค้ามนุษย์ (ปกค.) ซึ่งรองนายกรัฐมนตรีเป็นประธาน และคณะอนุกรรมการต่าง ๆ เพื่อผลักดันนโยบายระดับชาติ นอกจากนี้ พรบ. ดังกล่าว ยังได้มีการกำหนดให้จัดตั้งกองทุนเพื่อการป้องกันและปราบปรามการค้ามนุษย์ โดยมีการใช้เงินทุนในสองส่วน ได้แก่ การช่วยเหลือผู้เสียหายจากการกระทำความผิดฐานค้ามนุษย์ และ การดำเนินโครงการเพื่อป้องกันและปราบปรามการค้ามนุษย์ ซึ่งหน่วยงานทั้งภาครัฐและองค์กรเอกชนสามารถเสนอโครงการเพื่อขอใช้งบประมาณกองทุนฯ โดยเลขาธิการของกลไกระดับชาติ รวมทั้งการบริหารกองทุนฯ อยู่ในความรับผิดชอบของกระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ (พม.)

ในระดับจังหวัด มีคณะกรรมการป้องกันและปราบปรามการค้ามนุษย์ระดับจังหวัด ซึ่งประกอบด้วยกรรมการจากส่วนราชการที่เกี่ยวข้อง โดยผู้ว่าราชการจังหวัดเป็นประธาน และในระดับหน่วยงาน หลายหน่วยงานได้จัดตั้งหน่วยงานย่อยที่มีภารกิจเฉพาะ โดยเฉพาะหน่วยงานที่เกี่ยวข้องกับการปราบปราม เช่น กองบังคับการปราบปรามการกระทำผิดเกี่ยวกับการค้ามนุษย์ ภายใต้สำนักงานตำรวจแห่งชาติ ศูนย์ต่อต้านการค้ามนุษย์ระหว่างประเทศ ภายใต้สำนักงานอัยการสูงสุด เป็นต้น

ทั้งนี้ รัฐบาลเน้นการมีส่วนร่วมของภาคประชาสังคมในกลไกทั้งในระดับชาติ โดยมีผู้ทรงคุณวุติจากภาคประชาสังคมเป็นกรรมการในคณะกรรมการระดับชาติ และระดับจังหวัด โดยมีองค์กรพัฒนาเอกชนเข้าร่วมเป็นคณะกรรมการ และมีส่วนร่วมอย่างมีนัยสำคัญในกระบวนการคัดแยกเหยื่อด้วย



๒. การดำเนินนโยบายที่เกี่ยวข้องกับการป้องกันและปราบปรามการค้ามนุษย์

เนื่องจากไทยอยู่ในสถานะประเทศต้นทาง ทางผ่าน และปลายทางของการค้ามนุษย์ นโยบายเพื่อแก้ไข ป้องกัน และปราบปรามการค้ามนุษย์ของไทย ให้ความสำคัญกับผู้เสียหายจากการค้ามนุษย์เป็นหลัก (Victim-Centered) และมีความเกี่ยวข้องกับการดำเนินงานหลายด้านที่เกี่ยวข้องกับการป้องกันการแสวงประโยชน์หรือการบังคับใช้แรงงาน การปราบปรามและดำเนินคดีขบวนการค้ามนุษย์ รวมถึงการช่วยเหลือคุ้มครองผู้เสียหายจากการค้ามนุษย์ ซึ่งนโยบายที่ไทยกำลังให้ความสำคัญในปัจจุบัน มีดังนี้

การดำเนินงานเกี่ยวกับผู้โยกย้ายถิ่นฐานที่เหมาะสมของไทย เมื่อเดือนกันยายน ๒๕๕๖ นายกรัฐมนตรีได้เป็นประธานการประชุมหารือในประเด็นดังกล่าว โดยเน้นการเคารพหลักสิทธิมนุษยชน และประสงค์ให้แรงงานต่างด้าวทั้งหมดได้รับการจดทะเบียนและพิสูจน์สัญชาติให้เรียบร้อยเพื่อให้สามารถอยู่ทำงานในไทยได้อย่างถูกต้องและได้รับสิทธิ/การคุ้มครองทางสังคมต่าง ๆ โดยรัฐบาลกำลังพิจารณาเรื่อง การปรับสิทธิด้านการรักษาพยาบาลแรงงานต่างด้าวจากเดิมที่มีอยู่ให้ครอบคลุมและมีประสิทธิภาพยิ่งขึ้น ทั้งนี้ เพื่อรองรับการเตรียมตัวเข้าสู่ความเป็นประชาคมอาเซียน

๓. การดำเนินความร่วมมือระหว่างประเทศด้านการป้องกันและปราบปรามการค้ามนุษย์

กระทรวงการต่างประเทศมีภารกิจที่เกี่ยวข้องในด้านการให้ความช่วยเหลือผู้เสียหายชาวไทยในต่างประเทศ ผ่านการดำเนินงานของสถานเอกอัครราชทูตและสถานกงสุลทั่วโลก มีส่วนในกระบวนการกำหนดนโยบายโดยคณะกรรมการระดับชาติ และการดำเนินความร่วมมือในประเด็นการป้องกันและปราบปรามการค้ามนุษย์ระหว่างประเทศ ทั้งในระดับทวิภาคีและระดับพหุภาคี ซึ่งการดำเนินงานระดับระหว่างประเทศที่สำคัญ มีดังนี้
