๔. ข้อควรคำนึง/ข้อพิจารณาว่าด้วยมาตรการที่จะให้การดำเนินงานของคณะกรรมการ
สิทธิมนุษยชนแห่งชาติเป็นไปอย่างมีประสิทธิภาพและมีประสิทธิผล
ตามที่รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช ๒๕๕๗ มาตรา ๓๕ วรรคสอง บัญญัติให้คณะกรรมาธิการยกร่างรัฐธรรมนูญพิจารณาถึงความจำเป็นและความคุ้มค่าที่ต้องมีองค์กรตามรัฐธรรมนูญหรือองค์กรที่ก่อตั้งโดยอาศัยอำนาจตามรัฐธรรมนูญ ในกรณีที่จำเป็นต้องมี ให้พิจารณามาตรการที่จะให้การดำเนินงานขององค์กรดังกล่าวเป็นไปอย่างมีประสิทธิภาพและประสิทธิผลด้วย นั้น คณะกรรมการสิทธิมนุษยชนแห่งชาติมีข้อเสนอแนะเกี่ยวกับมาตรการเพิ่มประสิทธิภาพและประสิทธิผลในการดำเนินงานขององค์กรในด้านต่าง ๆ ไว้แล้ว ได้แก่ ด้านการตรวจสอบการละเมิดสิทธิมนุษยชน ด้านการเสนอเรื่องพร้อมด้วยความเห็นต่อศาลรัฐธรรมนูญ ศาลปกครอง และการฟ้องคดีต่อศาลยุติธรรมแทนผู้เสียหาย ด้านการเสนอแนะนโยบายและข้อเสนอในการปรับปรุงกฎหมายและกฎต่อรัฐสภาหรือคณะรัฐมนตรี ด้านการส่งเสริมสิทธิมนุษยชนและประสานงานเครือข่าย และด้านการจัดทำรายงานประจำปีเพื่อประเมินสถานการณ์สิทธิมนุษยชนภายในประเทศ (ดังปรากฏตามสิ่งที่ส่งมาด้วย ๓ และ ๔) ทั้งนี้ ในการปรับรูปแบบและกลไกที่จะเพิ่มประสิทธิภาพและประสิทธิผลตามหลักการของมาตรา ๓๕ วรรคสอง มีความจำเป็นที่จะต้องมีองค์กรคณะกรรมการสิทธิมนุษยชนแห่งชาติที่เป็นเอกเทศ
