ต่อมากระทรวงกลาโหมได้เสนอพระราชบัญญัติจัดตั้งองค์การสงเคราะห์ทหารผ่านศึกขึ้น โดยได้ผ่านการเห็นชอบจากรัฐบาล และได้มีการประกาศไว้ใน
ราชกิจจานุเบกษา เมื่อวันที่ 3 กุมภาพันธ์ พ.ศ.2491 จึงได้ยึดเอาวันที่ 3 กุมภาพันธ์ของทุกปี เป็นวันทหารผ่านศึก โดยมี พลโท ชมะบูรณ์ ไพรีระย่อเดช เป็นผู้อำนวยการคนแรก ในปี พ.ศ.2510 องค์การทหารผ่านศึกได้ปรับเปลี่ยนฐานะมาเป็นองค์การเพื่อการกุศลของรัฐ และเป็นนิติบุคคลตามกฎหมาย โดยได้รับเงินอุดหนุนจากกระทรวงกลาโหมและเงินที่รัฐบาลกำหนดให้เป็นครั้งคราว ภารกิจหลักขององค์การทหารผ่านศึก ได้แก่ การให้การสงเคราะห์แก่ทหารที่ผ่านการปฎิบัติการรบ และครอบครัวของทหารที่ปฏิบัติการรบ
