ข้อ 8. กรณีผิดสัญญา
8.1 ในกรณีที่คู่สัญญาฝ่ายหนึ่งฝ่ายใดปฏิบัติผิดสัญญาข้อหนึ่งข้อใดในสัญญานี้ คู่สัญญาอีกฝ่ายหนึ่งจะส่งคำบอกกล่าวเป็นหนังสือแจ้งเตือนให้ฝ่ายที่ปฏิบัติผิดสัญญาได้รับทราบและปฏิบัติให้ถูกต้องตามสัญญาภายในระยะเวลา 60 (หกสิบ) วัน นับจากวันที่ได้รับหนังสือแจ้งเตือน หากฝ่ายที่ปฏิบัติผิดสัญญาไม่ดำเนินการให้ถูกต้องตามสัญญาภายในกำหนดระยะเวลาดังกล่าว คู่สัญญาอีกฝ่ายหนึ่งมีสิทธิบอกเลิกสัญญานี้พร้อมทั้งมีสิทธิเรียกค่าเสียหายใด ๆ ที่เกิดขึ้นจากฝ่ายที่ปฏิบัติผิดสัญญาได้
8.2 หากการสิ้นสุดสัญญาก่อนกำหนดเป็นผลมาจากการผิดสัญญาของผู้รับบริการ ผู้รับบริการรับทราบและตกลงว่าจะไม่เรียกค่าใช้จ่าย และ/หรือค่าเสียหายอย่างใด ๆ อันเกิดจากการให้บริการสื่อโฆษณาตามสัญญานี้จากผู้ให้บริการ พร้อมทั้งตกลงที่จะชำระค่าเสียหายเช่นเดียวกับที่ได้ปรากฎในข้อ 5.3
8.3 ในกรณีที่คู่สัญญาฝ่ายใดฝ่ายหนึ่งเลิกกิจการหรือล้มละลาย หรือมีเหตุอื่นใดตามกฎหมายที่ทำให้คู่สัญญาฝ่ายนั้นไม่สามารถดำเนินการตามสัญญาฉบับนี้ต่อไปได้ ให้สัญญาฉบับนี้มีผลสิ้นสุดลงโดยทันที และให้ถือว่าหน้าที่ความรับผิดของคู่สัญญาฝ่ายดังกล่าวที่ยังคงมีอยู่ก่อนสัญญาสิ้นสุดลงยังคงมีผลบังคับใช้อยู่
