ภายหลังสงครามโลกครั้งที่ 2 “ โฮจิมินห์” ผู้นําขบวนการเวียดมินห์ยึดอํานาจได้จาก จักรพรรดิเป๋าได๋ (Bao-Dai) และประกาศให้เวียดนามเป็นเอกราช เมื่อวันที่ 2 กันยายน ค.ศ. 1945
เป็นอันสิ้นสุดระบอบจักรพรรดิในเวียดนามแต่หลังจากฝรั่งเศสรบแพ้ที่เดียนเบียนฟู ฝรั่งเศสจึงยอมให้เอกราชแก่เวียดนามตามข้อตกลง เจนีวาข้อตกลงดังกล่าวแบ่งเวียดนามออกเป็น 2 ส่วนได้แก่เวียดนามเหนือและเวียดนามใต้ “ เวียดนามเหนือเป็นสังคมนิยมในค่ายโลกคอมมิวนิสต์” “ ส่วนเวียดนามใต้เป็นประชาธิปไตยในค่ายโลกเสรี ”
ในช่วงที่เวียดนามเป็นเมืองขึ้นของฝรั่งเศสเวียดนามมีชื่อว่า อันนัม และได้ชื่อประเทศเวียดนามอย่างเป็นทางการเมื่อปี ค.ศ.1945 ชาวเวียดนามชอบท่องคำขวัญสมัยใหม่ว่า เวียดนามเป็นชื่อประเทศ มิใช่สงคราม ในประเทศจีน ภาษาเวียดนามอ่านออกเสียงว่า เหวียต หมายถึง ไกลออกไปส่วนเวียดนามออกเสียงว่า นาม หมายถึงทิศใต้คงหมายถึงประเทศที่อยู่ทางใต้ของจีนอย่างเวียดนาม

- สภาแห่งชาติ (The National Assembly หรือ Quoc-Hoi) เป็นองค์กรฝ่ายนิติบัญญัติ มีอำนาจในการแก้ไขรัฐธรรมนูญและการออกกฎหมายต่างๆ นอกจากนี้ ยังมีอำนาจให้ความเห็นชอบในการแต่งตั้งและถอดถอนประธานาธิบดี นายกรัฐมนตรีและรองนายกรัฐมนตรี
- องค์กรฝ่ายบริหาร ทำหน้าที่กำหนดนโยบายและบริหารประเทศ
- รัฐบาลท้องถิ่น (People’s Committee of Province) เวียดนามมีสภาประชาชนและคณะกรรมการประชาชนประจำท้องถิ่นเป็นองค์กรบริหารสูงสุดประจำท้องถิ่น โดยรัฐบาลท้องถิ่นจะบริหารงานตามกฎหมายรัฐธรรมนูญ และกฎระเบียบที่รัฐบาลกลางบัญญัติไว้
