อาศัยอํานาจตามความในมาตรา ๗ วรรคหนึ่ง แห่งพระราชบัญญัติประกันสังคม พ.ศ. ๒๕๓๓
และมาตรา ๔๖ วรรคหนึ่งและวรรคสอง แห่งพระราชบัญญัติประกันสังคม พ.ศ. ๒๕๓๓ ซึ่งแก้ไข
เพิ่มเติมโดยพระราชบัญญัติประกันสังคม(ฉบับที่ ๓) พ.ศ. ๒๕๔๒ อันเป็นกฎหมายที่มีบทบัญญัติบางประการ
เกี่ยวกับการจํากัดสิทธิและเสรีภาพของบุคคล ซึ่งมาตรา ๒๙ ประกอบกับมาตรา ๓๓ มาตรา ๔๑
และมาตรา ๔๓ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย บัญญัติให้กระทําได้โดยอาศัยอํานาจตาม
บทบัญญัติแห่งกฎหมาย รัฐมนตรีว่าการกระทรวงแรงงานออกกฎกระทรวงไว้ ดังต่อไปนี้
ข้อ ๑ กฎกระทรวงนี้ให้ใช้บังคับตั้งแต่วันที่ ๑ มกราคม พ.ศ. ๒๕๕๖ เป็นต้นไป
ข้อ ๒ ให้ยกเลิกกฎกระทรวงกําหนดอัตราเงินสมทบกองทุนประกันสังคม พ.ศ. ๒๕๕๕
ข้อ ๓ ให้รัฐบาล นายจ้าง และผู้ประกันตนตามมาตรา ๓๓ ออกเงินสมทบเข้ากองทุนเพื่อ
การจ่ายประโยชน์ทดแทนกรณีประสบอันตรายหรือเจ็บป่วย กรณีทุพพลภาพ กรณีตาย กรณีคลอดบุตร
กรณีสงเคราะห์บุตร และกรณีชราภาพ ตามบัญชีอัตราเงินสมทบท้ายกฎกระทรวงนี้ ดังต่อไปนี้
(๑) ตั้งแต่วันที่ ๑ มกราคม พ.ศ. ๒๕๕๖ ถึงวันที่ ๓๑ ธันวาคม พ.ศ. ๒๕๕๖ ให้เป็นไป
ตามอัตราในบัญชี ก.
(๒) ตั้งแต่วันที่ ๑ มกราคม พ.ศ. ๒๕๕๗ เป็นต้นไป ให้เป็นไปตามอัตราในบัญชี ข.
ให้ไว้ ณ วันที่ ๒๗ กุมภาพันธ์ พ.ศ. ๒๕๕๖
