บทคัดย่อ
การแพทย์มีความหมายเกี่ยวกับการรักษา ซึ่งผู้ที่ทำหน้าที่ในการตรวจรักษาก็คือ นายแพทย์หรือคุณหมอ บทความเรื่องนี้จึงเป็นเรื่องเกี่ยวกับตัวแพทย์ว่าเป็นผู้มีจริยธรรมหรือไม่ และปัญหาจริยธรรมที่แพทย์ต้องประสบ คิดแก้ไขตัดสินใจ โดยใช้แนวคิดทฤษฏีพุทธจริยศาสตร์ มาใช้กับการแพย์และเป็นเกณฑ์ตัดสินจริยธรรมพฤติกรรมของแพทย์ว่า ถูกต้องหรือไม่ถูกต้อง สมควรหรือไม่สมควร ควรส่งเสริมหรือควรมีมาตรการป้องกัน
จากประเด็นปัญหาที่ว่าการวิจัยยาในมนุษย์เป็นการกระทำที่ถูกต้องหรือไม่นั้นพบว่าการวิจัยยาในมนุษย์นั้นหากแพทย์แยกชัดเจนว่าการรักษาหรือการวิจัย ถ้าแยกชัดผู้ป่วย/อาสาสมัครทราบมีขั้นตอนการให้คำยินยอมก็ถือว่า “ถูก” หลักเกณฑ์การแพทย์แนวพุทธ กฎสมบูรณ์ ก็คือ สัจธรรม คือ ความจริง และถูกหลักสิทธิมนุษยชน รวมทั้งถูกหลักของประโยชน์นิยม แต่หากว่าแพทย์ทั้งรักษาและวิจัยไปด้วย เป็นการรักษาที่ผู้ป่วยไม่ทราบว่ากำลังเป็นผู้ถูกทดลอง อาจจะเป็นด้วยเหตุผลที่แพทย์พิจารณาแล้วว่าจะส่งผลทำให้ผู้ป่วยวิตกกังวล ก็ถือว่า “ถูก” หลักเกณฑ์การแพทย์แนวพุทธ เพราะถึงแม้จะไม่ถูกตามหลักสัจธรรมนัก แต่ดูที่เจตนาว่าพิจารณาใคร่ครวญดีแล้ว และถูกหลักประโยชน์นิยม แต่ผิดกฎสมบูรณ์ประเด็นนี้ในส่วนหลักสิทธิมนุษยชนหากไม่มีการฟ้องร้องทางกฎหมายก็ไม่ผิด แต่หากผู้ป่วยทราบในหลังและถือว่าละเมิดสิทธิฟ้องร้องก็ผิด ในทางกลับกันหากแพทย์ได้รับผลประโยชน์ทางการวิจัย และผู้ป่วยไม่ทราบ แม้ผลจะทำให้ผู้ป่วยหายป่วยก็ผิดหลักการแพทย์แนวพุทธ กฎสมบูรณ์ หากมีการฟ้องก็ผิดกฎหมาย แต่ถูกหลักประโยชน์นิยม เพราะมองเห็นว่าให้ผลแก่คนส่วนรวมได้มากกว่า
ส่วนใหญ่ปัญหาการฟ้องร้องบุคลากรทางการแพทย์มาจากความคาดหวังของผู้ป่วยหรือญาติ โดยมีสาเหตุมาจากการไม่รู้ข้อเท็จจริง ไม่เข้าใจกระบวนการรักษา ข้อจำกัด รวมทั้งความผิดพลาดบกพร่องของบุคลากรทางการแพทย์ สิ่งสำคัญของแพทย์การพัฒนาวิชาความรู้ทางด้านศีลธรรม คุณธรรม จริยธรรม ควบคู่ไปกับหลักวิชาการและหลักประโยชน์นิยม มุ่งสร้างจิตสำนึกแพทย์ที่เป็นทั้งผู้รักษาและนักวิจัยที่ดีมีจิตสำนึก ก็จะทำให้ประชาชนมีความศรัทธาในตัวแพทย์และสถาบันทางการแพทย์มีความยั่งยืนสืบไปอย่างเต็มภาคภูมิ
