1. มีถิ่นที่อยู่ในราชอาณาจักรหรือได้รับอนุญาตให้เข้ามาในราชอาณาจักรเป็นการชั่วคราว

2. มีความรู้ความสามารถในการทำงานตามที่ขอรับใบอนุญาตทำงาน

3. ต้องไม่เป็นคนวิกลจริตหรือจิตฟั่นเฟือนไม่สมประกอบ

4. ต้องไม่เป็นผู้เจ็บป่วยด้วยโรคเรือน วัณโรคในระยะอันตราย โรคเท้าช้างในระยะปรากฎอาการเป็นที่น่ารังเกียจแก่สังคม โรคยาเสพติดให้โทษอย่างร้ายแรง โรคพิษสุราเรื้อรัง

5. ต้องไม่เคยต้องโทษจำคุกในความผิดตามกฎหมายว่าด้วยคนเข้าเมืองหรือตามกฎหมายว่าด้วยการทำงานของคนต่างด้าว ภายในระยะเวลาหนึ่งปีก่อนวันขอรับใบอนุญาต

คนต่างด้าวที่มีใบอนุญาตทำงานแล้ว ต้องปฏิบัติ ดังนี้

1. มีใบอนุญาตติดตัวไว้หรือมีอยู่ ณ ที่ทำงานในระหว่างทำงานเพื่อแสดงต่อเจ้าหน้าที่ได้ตลอดเวลา (ผู้ฝ่าฝืนมีโทษปรับไม่เกิน 10,000.- บาท)

4 ก่อนใบอนุญาตทำงานสิ้นอายุ และประสงค์จะทำงานต่อต้องยื่นคำขอต่ออายุใบอนุญาตก่อนจึงจะทำงานได้

5. กรณีใบอนุญาตชำรุดหรือสูญหาย ต้องยื่นขอใบแทนใบอนุญาตภายใน 15 วัน นับแต่วันที่ทราบ

6. กรณีเปลี่ยนชื่อ ชื่อสกุล สัญชาติ ที่อยู่อาศัยของคนต่างด้าว หรือชื่อสถานที่ทำงาน ต้องยื่นคำร้องขอแก้ไขโดยไม่ชักช้า
