. คุณสมบัติของผู้ตรวจสอบ

ผู้ตรวจสอบจะเป็นนิติบุคคลหรือบุคคลธรรมดาก็ได้ โดยต้องมีคุณสมบัติดังต่อไปนี้

(1) ถ้าเป็นบุคคลธรรมดา

(ก) มีสัญชาติไทย

(ข) ได้รับอนุญาตให้เป็นผู้ประกอบวิชาชีพวิศวกรรมควบคุมตามกฎหมายว่าด้วยวิศวกร

หรือเป็นผู้ประกอบวิชาชีพสถาปัตยกรรมควบคุมตามกฎหมายว่าด้วยสถาปนิก แล้วแต่กรณี

(ค) ผ่านการอบรมหลักสูตรเกี่ยวกับวิธีการตรวจสอบสภาพอาคารและอุปกรณ์ประกอบ

ของอาคารตามที่คณะกรรมการควบคุมอาคารรับรอง

(ง) ไม่เคยถูกเพิกถอนการขึ้นทะเบียนเป็นผู้ตรวจสอบในระยะเวลาสองปีก่อนวันขอขึ้นทะเบียนเป็นผู้ตรวจสอบ

(2) ถ้าเป็นนิติบุคคล

(ก) ต้องจดทะเบียนตามกฎหมายไทย โดยทุนจดทะเบียนไม่น้อยกว่ากึ่งหนึ่งต้องเป็นของ

ผู้มีสัญชาติไทย และมีผู้เป็นหุ้นส่วน ผู้ถือหุ้นหรือกรรมการเป็นผู้มีสัญชาติไทยไม่น้อยกว่ากึ่งหนึ่งของจํานวนผู้เป็นหุ้นส่วน ผู้ถือหุ้นหรือกรรมการทั้งหมด

(ข) ได้รับอนุญาตให้เป็นผู้ประกอบวิชาชีพวิศวกรรมควบคุมตามกฎหมายว่าด้วยวิศวกร

หรือเป็นผู้ประกอบวิชาชีพสถาปัตยกรรมควบคุมตามกฎหมายว่าด้วยสถาปนิก แล้วแต่กรณี

(ค) สมาชิกในคณะผู้บริหารของนิติบุคคลจํานวนไม่น้อยกว่ากึ่งหนึ่งต้องผ่านการอบรม

หลักสูตรเกี่ยวกับวิธีการตรวจสอบสภาพอาคารและอุปกรณ์ประกอบของอาคารที่คณะกรรมการควบคุม

(ง) สมาชิกในคณะผู้บริหารของนิติบุคคลตาม (ค) ต้องไม่เคยถูกเพิกถอนการขึ้นทะเบียน
