กำหนดหลักเกณฑ์และวิธีการตรวจสุขภาพของลูกจ้าง
และส่งผลการตรวจแก่พนักงานตรวจแรงงาน
พ.ศ. ๒๕๔๗
อาศัยอำนาจตามความในมาตรา ๖ และมาตรา ๑๐๗ แห่งพระราชบัญญัติคุ้มครองแรงงาน พ.ศ. ๒๕๔๑ อันเป็นพระราชบัญญัติที่มีบทบัญญัติบางประการเกี่ยวกับการจำกัดสิทธิและเสรีภาพของบุคคล ซึ่งมาตรา ๒๙ ประกอบกับมาตรา ๓๑ มาตรา ๓๕ มาตรา ๔๘ และมาตรา ๕๐ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย บัญญัติให้กระทำได้โดยอาศัยอำนาจตามบทบัญญัติแห่งกฎหมาย รัฐมนตรีว่าการกระทรวงแรงงานออกกฎกระทรวงไว้ ดังต่อไปนี้
ข้อ ๑ กฎกระทรวงนี้ให้ใช้บังคับเมื่อพ้นกำหนดเก้าสิบวันนับแต่วันประกาศในราชกิจจานุเบกษา เป็นต้นไป
ข้อ ๒ ในกฎกระทรวงนี้
“การตรวจสุขภาพ” หมายความว่า การตรวจร่างกายและสภาวะทางจิตใจตามวิธีทางการแพทย์เพื่อให้ทราบถึงความเหมาะสม และผลกระทบต่อสุขภาพของลูกจ้างอันอาจเกิดจากการทำงาน
“งานเกี่ยวกับปัจจัยเสี่ยง” หมายความว่า งานที่ลูกจ้างทำเกี่ยวกับ
(๑) สารเคมีอันตรายตามที่รัฐมนตรีประกาศกำหนด
(๒) จุลชีวันเป็นพิษซึ่งอาจเป็นเชื้อไวรัส แบคทีเรีย รา หรือสารชีวภาพอื่นตามที่รัฐมนตรีประกาศกำหนด
(๓) กัมมันตรังสี
