กฎหมายเกี่ยวกับร้านกาแฟ

การจะเปิดร้านกาแฟนั้น ต้องรู้หลักการทางกฎหมายเกี่ยวกับกาแฟไว้บ้าง เพราะทุกที่ต้องมีกฎกติกา หากเราต้องการเปิดร้านกาแฟและจดทะเบียนให้ถูกต้องตามกฎเกณฑ์แล้ว ควรรู้กฎหมายเกี่ยวกับกาแฟไว้

โดยที่เป็นการสมควรปรับปรุงประกาศกระทรวงสาธารณสุขว่าด้วย
เรี่อง กาแฟ
อาศัยอำนาจตามความในมาตรา 5 และมาตรา 6 (3) (4) (5) (6)
(7) และ (10) แห่งพระราชบัญญิตอาหาร พ.ศ. 2522 อันเป็นพระราชบัญญัติ
ที่มีบทบัญญัติบางประการเกี่ยวกับการจำกัดสิทธิและเสรีภาพของบุคคล ซึ่ง
มาตรา 29 ประออบกับมาตรา 35 มาตรา 48 และมาตรา 50 ของรัฐธรรมนูญ
แห่งราชอาณาจักรไทย บัญญัติให้กระทำได้โดยอาศัยอำนาจตามบทบัญญัติ
แห่งกฎหมาย รัฐมนตรีว่าการกระทรวงสาธารณสุขออกประกาศไว้ ดังต่อไปนี้
ข้อ 1 ให้ยกเลิก
(1) ประกาศกระทรวงสาธารณสุข ฉบับที่ 77 (พ.ศ. 2527) เรื่องกาแฟ
ลงวันที่ 13 มกราคม พ.ศ. 2527
(2) ประกาศกระทรวงสาธารณสุข ฉบับที่ 132 (พ.ศ. 2533) เรื่อง
กาแฟ (ฉบับที่ 2) ลงวันที่ 15 ตุลาคม พ.ศ. 2533
(3) ประกาศกระทรวงสาธารณสุข (ฉบับที่ 181 ) พ.ศ. 2540 เรื่อง
กาแฟ (ฉบับที่ 3) ลงวันที่ 21 พฤศจิกายน พ.ศ. 2540

ข้อ 2 ให้กาแฟที่คั่วแล้ว เป็นอาหารที่กำหนดคุณภาพหรีอมาตรฐาน

ข้อ 3 กาแฟตามข้อ 2 แบ่งออกเป็น 6 ชนิด ดังต่อไปนี้
( 1) กาแฟแท้ หมายความว่า ผลิตภัณฑ์ที่ได้จากผลที่แก่จัดของต้น
กาแฟในสกุล คอฟเฟีย (coffea) ผ่านกรรมวิธีเอาเมล็ดออก นำเมล็ดมาคั่ว
จนได้ที่ และอาจบดให้ได้ขนาดตามความต้องการ
(2) กาแฟผสม หมายความว่า ผลิตภัณฑ์ที่ได้จากอาแฟตาม (1)
ที่มีสิ่งอื่นที่ไม่เป็นอันตรายต่อสุขภาพเป็นส่วนผสมอยู่ด้วย
(3) กาแฟที่สกัดกาเฟอีนออก หมายความว่า ผลิตภัณฑ์ที่ได้จาก
กาแฟตาม ( 1 ) ที่ได้สกัดเอากาเฟอีนออก
(4) กาแฟสำเร็จใป หมายความว่า ผลิตภัณฑ์ที่ได้จากผลที่แก่่จัด
ของต้นกาแฟในสกุลคอฟเฟีย ผ่านกรรมวิธีเอาเมล็ดออก นำเมล็ดมาคั่วจนได้ที
โดยมิได้มีการผสมสิ่งอื่นใด แล้วนำมาสกัดด้วยน้ำเท่านั้น นำไประเหยน้ำออก
จนแห้งด้วยกรรมวิธีที่เหมาะสม มีลักษณะเป็นผง หรือเป็นเกล็ด หรือลักษณะ
อื่นๆ นเละสามารถละลายน้ำได้หมดทันที
(5) กาแฟสาเร็จรูปผสม หมายความว่า กาแฟสำเร็จรูปตาม (4) ที
มีสิ่งอื่นที่ไม่เป็นอันตรายต่อสุขภาพเป็นส่วนผสมอยู่ด้วย
(6) กาแฟสาเร็จรูปที่สกัดกาเฟอีนออก หมายความว่า ผลิตภัณท์ที
ได้จากกาแฟตาม (4) ที่ได้สกัดเอากาเฟอีนอออ ในกรณีที่นำกาแฟตาม ( 1 )
(2) (3) (4) (5) หรีอ (6) มาปรุงแต่งรสในลักษณะพร้อมบริโภคและบรรจุใน
ภาชนะปิดสนิท ไม่ว่าผลิตภัณฑ์ดังกล่าวจะเป็นชนิดเหลวหรีอแห้ง ให้ถือว่า
เป็นกาแฟงงต้องปฏิบัติตามประกาศฉบับนี้ด้วย

ข้อ 4 กาแฟแท้ต้องมีคุณกาพหรีอมาตรฐาน ดังต่อไปนี้
( 1 ) มีกลิ่นและรสของกาแฟแท้
(2) มีเถ้าทั้งหมดไม่เกิินร้อยละ 6 ของน้ำหนัก และเถ้าทั้งหมดนั้นต้องละลายน้ำได้ไม่น้อยกว่าร้อยละ 75 ของน้ำหนัก
(3) มีกาเฟอีนไม่น้อยกว่าร้อยละ 1 ของน้ำหนัก
(4) มีน้ำตาล คำนวณเป็นน้ำตาลอินเวิร์ตทั้งหมดได้ไม่เกินร้อยละ 1.5 ของน้ำหนัก
(5) ไม่ผสมวัตถุอื่นใด ยกเว้นวัตถุที่ไม่เป็นอันตรายต่อสุขภาพที่ใช้เพื่อสารคั่วและแต่่งกลิ่น
(6) ไม่ใช้สี เว้นแต่สีน้ำตาลเคี่ยวไหม้หรือสีคาราเมล

ข้อ 5 กาแฟผสมต้องมีคุณภาพหรือมาตรฐาน ดังต่อไปนี้
(1) มีกาแฟเป็นส่วนผสมไม่น้อยกว่าร้อยละ 20 ของน้ำหนักเมื่อแห้ง
(2) ใช้วัตถุที่ให้ความหวานแทนน้ำตาลได้ตามมาตรจาน เอฟ เอ โอ
ดับบลิว เอช โอ โคเด็กช์ (Joint FAO/WHO' codex) ที่ว่าด้วยเรื่องวัตถุ
เจือปนอาหาร และฉบับที่ได้แก้ไขเพิ่มเติมในกรณีที่ไม่มีมาตรฐาน กำหนดไว้
ตามวรรคหนึ่ง ให้สำนักงานคณะกรรมการอาหารและยาประกาศกำหนด
โดยความเห็นชอบของคณะกรรมการอาหาร
(3) มีคุณภาพหรีอมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงานคณะกรรมการอาหารและยา

ข้อ 6 กาแฟที่สกัดกาเฟอีนออก ต้องมีคุณภาพหรือมาตรจานดังต่อไปนี้
(1 ) มีกาเฟอีนไม่เกินร้อยละ 0. 1 ของน้ำหนัก
(2) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงาน
คณะกรรมการอาหารและยา

ข้อ 7 กาแฟสำเร็จรูป ต้องมีคุณภาพหรีอมาตรฐานดังต่อไปนี้
( 1 ) มีกลิ่นและรสของกาแฟแท้
(2) มีความจ้นไม่เกินร้อยละ 5 ของน้ำหนัก
(3) มีเถ้าทั้งหมดไม่น้อยกว่าร้อยละ 5 ของน้ำหนักเมื่อแห้ง
(4) มีกาเฟอีนไม่น้อยกว่าร้อยละ 2.5 ของน้ำหนัก

ข้อ 8 กาแฟสำเร็จรูปผสม ต้องมีคุณภาพหรีอมาตรฐานดังต่อไปนี้
(1) มีความจ้นไม่เกินร้อยละ 5 ของน้ำหนัก
(2) มีกาเฟอีนไม่น้อยกว่าร้อยละ 1.5 ของน้ำหนัก
(3) ไม่ใช้สี เว้นเเต่ สีน้ำตาลเคี่ยวไหม้หรือสีคาราเมล
(4) ใช้วัตถุที่ให้ความหวานแทนน้ำตาลได้ตามมาตรฐาน เอฟ เอ โอ/ดับบลิว นอช โอ โคเด็กช์ (Jolnt FAO/WHO' codex) ที่ว่าด้วยเรี่อง วัตถุ
เจือปนอาหาร และฉบ้บที่ได้แก้ใขเพิ่มนติมในกรณีที่ไม่มีมาตฐานกำหนดไว้
ตามวรรคหนึ่ง ให้สำนักงานคณะกรรมการอาหารและยาประกาศกำหนด
โดยความเห็นชอบของคณะกรรมการอาหาร
(5) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงานคณะกรรมการอาหารและยา

ข้อ 9 กาแฟสำเร็จรูปที่สกัดกาเฟอีนออก ต้องมีคุณภาพหรือมาตรฐานดังต่อไปนี้
(1) มีความชื้นไม่เกินร้อยละ 5 ของน้ำหนัก
(2) มีอาเฟอีนไม่เกินร้อยละ 0.3 ของน้ำหนัก
(3) มีคุณภาพหรือมาตรฐานตามที่ได้รับความเห็นชอบจากสำนักงาน
คณะกรรมการอาหารและยา

ข้อ10 กาแฟตามวรรคสองของข้อ 3 ชนิดเหลว ต้องมีคุณภาพหรือมาตรจาน
ดังต่อไปนี้
( 1) มีกลิ่นและรสตามลักษณะเฉพาะของกาแฟนั้น
(2) มีกาเฟอีนไม่เกิน 100 มิลลิกรัม ต่อกาแฟปรุงสำเร็จชนิดเหลว
100 มิลลิลิตร และกาเฟอีนดังกล่าวต้องมาจากกาแฟที่ใช้เป็นวัตถุดิบเท่านั้น
(3) ตรวจพบแบคทีเรียชนิดโคลิฟอร์ม น้อยกว่า 2.2 ต่อกาแฟ 100
มิลลิลิตร โดยวิธีเอ็ม พี เอ็น (Most Proboble Number)
(4) ตรวจไม่พบแบคทีเรียชนิด อี.โคไล (Escherichia Coli)
(5) ไม่มีจุลินทรีย์ที่ทำให้เกิดโรค
(6) ไม่มีสารเป็นพิษจากจุลินทรีย์หรือสารเป็นพิษอื่นในปริมาณที่
อาจเป็นอันตรายต่อสุขภาพ
(7) ไม่มียีสต์และเชื้อรา
(8) ใช้วัตถุที่ให้ความหวานแทนน้ำตาลได้ตามมาตรฐาน เอฟ เอ โอ

ตามวรรคหนึ่ง ให้สำนักงานคณะกรรมการอาหารและยาประกาศกำหนดโดย
ความเห็นชอบของคณะกรรมการอาหาร (9) มีวัตถุกันเสียได้ ดังต่อไปนี้
(9.1) ซัลเฟอร์ไดออกไซด์ ไม่เกิน 70 มิลลิกรัม ต่อกาแฟปรุงสำเร็จ 1 กิโลกรัม
(9.2) กรดเบนโซอิค หรือกรดซอร์บิค หรือเกลีอของกรดทั้งสองนี้
