ทั้งสองฝ่ายตกลงทำสัญญากัน ดังมีข้อความดังต่อไปนี้ คือ

ข้อ 2. ในวันทำสัญญานี้ผู้จะขายจะได้รับเงินมัดจำจากผู้จะซื้อไว้แล้ว เป็นจำนวนเงิน 100,000 บาท(หนึ่งแสนบาทถ้วน) โดยชำระเป็นเงินสด ส่วนที่เหลือผู้จะซื้อตกลงชำระให้แก่ผู้จะขายทั้งหมดในวันที่โอนกรรมสิทธิ์
ข้อ 3. ผู้ซื้อและผู้ขายตกลงกันจะไปทำการจดทะเบียน โอนกรรมสิทธิ์กัน ณ ที่ทำการที่ดิน อำเภอแกลง ภายในระยะเวลา 15 วัน นับตั้งแต่.................................ถึง......................................
ข้อ 4. ค่าธรรมเนียมโอนและค่าใช้จ่ายต่าง ๆ ในการโอนกรรมสิทธิ์ ค่าภาษีเงินได้ ค่าอาการแสตมป์ ในการจดทะเบียนโอนกรรมสิทธิ์นี้ ทั้งสองฝ่ายตกลงให้ ผู้จะขาย เป็นฝ่ายชำระเพียงผู้เดียว
ข้อ 5. ผู้จะขายรับรองว่ามีสิทธิในการขายทรัพย์สินโดยสมบูรณ์ และรับรองว่าทรัพย์สินปราศจากการถูกรอนสิทธิ ภาระจำยอมหรือสิทธิเรียกร้องใดๆ และหากยังมีหนี้สินใดติดพัน ผู้จะขายจะต้องรับผิดชอบชำระให้เสร็จก่อน หรือ ภายในวันจดทะเบียนโอนกรรมสิทธ์
ข้อ 6. ถ้าผู้จะซื้อผิดสัญญาไม่ไปรับโอนตามกำหนดเวลาในข้อ 1. ให้ถือว่า ผู้จะซื้อผิดสัญญาและยินยอมให้ผู้จะขายริบมัดจำที่ชำระแล้วได้ทั้งหมดทันที โดยผู้จะขาย ไม่จำเป็นต้องบอกกล่าว และสัญญานี้เป็นอันยกเลิก แต่ถ้าผู้จะขายเป็นฝ่ายผิดสัญญาไม่สามารถจดทะเบียนโอนขายให้ผู้ซื้อได้ ผู้ขายต้องคืนมัดจำทั้งหมดแก่ผู้ซื้อ และยินยอมชำระค่าปรับแก่ผู้ซื้อ อีก 300,000 บาท (สามแสนบาทถ้วน)
สัญญานี้ทำขึ้นมีความถูกต้องตรงกัน คู่สัญญาได้อ่านและเข้าใจข้อความโดยตลอดแล้ว เห็นว่าถูกต้องตรงตามความประสงค์ จึงลงลายมือชื่อไว้เป็นหลักฐานต่อหน้าพยานเป็นสำคัญ และต่างเก็บไว้ฝ่ายละหนึ่งฉบับ
