ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ ผู้เช่า ” อีกฝ่ายหนึ่ง
ทั้งสองฝ่ายได้ตกลงทำสัญญากันมีข้อความดังต่อไปนี้ :-

ผู้ให้เช่าตกลงให้เช่าและผู้เช่าตกลงเช่าห้องชุดดังกล่าวข้างต้นซึ่งต่อไปในสัญญานี้จะเรียกว่า “ ห้องชุด ” มีกำหนดเวลาเช่า 5 (ห้า) ปี เริ่มตั้งแต่วันจดทะเบียนเช่าห้องชุดเป็นต้นไป
โดยมีวัตถุประสงค์เช่าห้องชุดเพื่อใช้ห้องชุดเป็นห้องพักอาศัยและอื่นๆในการประกอบ กิจการโรงแรมและการประกอบกิจการให้เช่าห้องชุดด้วย
หากผู้ให้เช่าไม่ได้จดทะเบียนซื้อรับโอนกรรมสิทธิ์ห้องชุดดังกล่าวให้ถือว่าไม่มีการตกลง เช่าห้องชุดและสัญญานี้เป็นอันยกเลิกกันทันทีตั้งแต่วันที่บุคคลอื่นได้จดทะเบียนซื้อรับโอนกรรมสิทธิ์ห้องชุดดังกล่าว โดยมิจำต้องบอกกล่าวยกเลิกสัญญานี้กันอีกแต่อย่างใด
ข้อ 2. คู่สัญญาตกลงค่าเช่าห้องชุดกันในอัตราค่าเช่ารายเดือน เดือนละ ……… บาท ( ......................................................... )

ข้อ 3. คู่สัญญาตกลงจะดำเนินการจดทะเบียนการเช่าตามสัญญานี้ต่อ เจ้าพนักงานที่ดิน โดยให้สัญญานี้แนบเป็นส่วนหนึ่งของหนังสือสัญญาเช่าห้องชุด ที่จดทะเบียน ดังกล่าวด้วย ทั้งนี้ภายใน 30 วัน นับแต่วันที่ผู้ให้เช่าจดทะเบียนซื้อรับโอนกรรมสิทธิ์ห้องชุดแล้ว โดยฝ่ายหนึ่งฝ่ายใดแจ้งกำหนดวันและเวลานัดจดทะเบียนดังกล่าวให้ผู้ให้เช่าทราบล่วงหน้า 7 วัน
o บรรดาค่าฤชาธรรมเนียมและค่าใช้จ่ายในการเช่าตามสัญญานี้ฝ่ายผู้ให้เช่าและ ผู้เช่าออกใช้เท่ากัน

ข้อ 4. ผู้เช่ามีหน้าที่สงวนห้องชุดเสมอวิญญูชนจะพึงสงวนรักษาทรัพย์สิน ของตนเอง และผู้เช่ามีหน้าที่บำรุงรักษาและทำการซ่อมแซมโดยผู้เช่าออกค่าใช้จ่ายเองทั้งสิ้น
ข้อ 5. ผู้เช่ายินดีให้ผู้ให้เช่าหรือตัวแทนของผู้ให้เช่าเข้าตรวจดูห้องชุด ในขณะที่ไม่มีผู้พักอยู่ในห้องชุดได้เป็นครั้งคราวภายในเวลาและระยะเวลาอันสมควร
ข้อ 6. ผู้เช่าเป็นผู้ชำระเงินเกี่ยวกับห้องชุดดังนี้

ผู้ให้เช่าตกลงยินยอมให้ผู้เช่าช่วงให้เช่าช่วงอีกทอดหนึ่งหรือโอนสิทธิของตนตามสัญญา เช่าช่วงหรือสัญญาโอนสิทธิไม่ว่าทั้งหมดหรือแต่บางส่วนให้แก่บุคคลภายนอกต่อไปอีกทอด หนึ่งได้ตามความประสงค์ของผู้เช่า ผู้เช่าช่วง หรือผู้รับโอนสิทธิทุกประการ โดยผู้ให้เช่า ไม่มีข้อแม้ ข้ออ้าง ข้อขัดข้อง และเรียกร้องเอาค่าตอบแทนแต่อย่างใด
ข้อ 8. ผู้ให้เช่าได้ให้คำมั่นสัญญาไว้ล่วงหน้าในสัญญานี้ว่า เมื่อครบกำหนด เวลาการเช่าห้องชุดตามสัญญานี้แล้ว ผู้ให้เช่า ตกลงให้ผู้เช่า ได้เช่าห้องชุดต่อไปอีกมีกำหนด เวลาเช่า 5 ปี นับแต่วันล่วงพ้นกำหนดเวลาเช่าตามสัญญานี้ ในอัตราค่าเช่ารายเดือน เดือนละ ………...…… บาท ( ......................................................... )
ข้อตกลงอื่นผู้ให้เช่าตกลงเช่นเดียวกับข้อตกลงตามสัญญานี้ทุกประการ โดยผู้เช่า ต้องมีหนังสือบอกกล่าวแจ้งความประสงค์ต้องการเช่าห้องชุดต่อไปอีกและกำหนดวันและเวลานัดทำหนังสือสัญญาเช่าห้องชุดล่วงหน้าก่อนวันสิ้นสุดเวลาเช่าตามสัญญานี้ไม่น้อยกว่า 60 วัน หากไม่มีการทำหนังสือสัญญาเช่าห้องชุดดังกล่าวให้ถือว่าผู้ให้เช่าได้ตกลงให้เช่าและผู้เช่าตกลง เช่าห้องชุดตามข้อตกลงดังกล่าวแล้ว โดยให้ถือเอาหนังสือสัญญานี้เป็นสัญญาเช่า ห้องชุดดังกล่าวโดยปริยายด้วย

ข้อ 9. การติดต่อคู่สัญญาทั้งสองฝ่ายให้ติดต่อ ณ สถานที่ตามที่อยู่ที่ระบุไว้ ข้างต้นในสัญญานี้ หากคู่สัญญาฝ่ายใดประสงค์จะเปลี่ยนแปลงที่อยู่หรือสถานที่ติด ต่อดังกล่าวให้แจ้งเป็นลายลักษณ์อักษรให้คู่สัญญาอีกฝ่ายทราบ
การส่งหนังสือให้แก่คู่สัญญาทางไปรษณีย์ลงทะเบียนตอบรับตามสถานที่อยู่ดังกล่าวในวรรคแรกให้ถือว่าคู่สัญญาอีกฝ่ายหนึ่งได้รับหนังสือนั้นโดยชอบตามกฎหมายแล้ว
การส่งหนังสือทางโทรสารให้แก่คู่สัญญาอีกฝ่ายหนึ่งตามที่ระบุไว้ข้างต้นในสัญญานี้ให้ถือว่าคู่สัญญาอีกฝ่ายหนึ่งได้รับหนังสือนั้นโดยชอบตามกฎหมายแล้ว
