เรื่อง มาตรการป้องกัน แก้ไข และติดตามตรวจสอบผลกระทบสิ่งแวดล้อม
สำหรับผู้ประกอบกิจการผลิตไฟฟ้าพลังงานแสงอาทิตย์จากเทคโนโลยีแผงโฟโตโวลเทอิก
ที่เข้าข่ายต้องได้รับใบอนุญาตประกอบกิจการผลิตไฟฟ้า
พ.ศ. ๒๕๕๗
โดยที่สมควรให้มีการดำเนินการจัดการด้านสิ่งแวดล้อม ความปลอดภัยและผลกระทบ
ที่อาจเกิดขึ้นต่อชุมชนในพื้นที่ใกล้เคียงสถานประกอบกิจการผลิตไฟฟ้าพลังงานแสงอาทิตย์จากเทคโนโลยี
แผงโฟโตโวลเทอิกที่เข้าข่ายต้องได้รับใบอนุญาตประกอบกิจการผลิตไฟฟ้า
อาศัยอำนาจตามข้อ ๔ ของระเบียบคณะกรรมการกำกับกิจการพลังงาน ว่าด้วยมาตรการป้องกัน
แก้ไข และติดตามตรวจสอบผลกระทบสิ่งแวดล้อมสำหรับผู้ได้รับการยกเว้นไม่ต้องจัดทำรายงานการวิเคราะห์
ผลกระทบสิ่งแวดล้อมตามกฎหมายว่าด้วยการส่งเสริมและรักษาคุณภาพสิ่งแวดล้อม พ.ศ. ๒๕๕๕
คณะกรรมการกำกับกิจการพลังงานจึงออกประกาศไว้ ดังนี้
ข้อ ๑ ประกาศนี้ เรียกว่า “ประกาศคณะกรรมการกำกับกิจการพลังงาน เรื่อง มาตรการป้องกัน
แก้ไข และติดตามตรวจสอบผลกระทบสิ่งแวดล้อมสำหรับผู้ประกอบกิจการผลิตไฟฟ้าพลังงานแสงอาทิตย์
จากเทคโนโลยีแผงโฟโตโวลเทอิกที่เข้าข่ายต้องได้รับใบอนุญาตประกอบกิจการผลิตไฟฟ้า พ.ศ. ๒๕๕๗”
ข้อ ๒ ประกาศนี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป
ข้อ ๓ ให้ผู้ประกอบกิจการผลิตไฟฟ้าพลังงานแสงอาทิตย์จากเทคโนโลยีแผงโฟโตโวลเทอิก
ที่ติดตั้งบนพื้นที่เข้าข่ายต้องได้รับใบอนุญาตประกอบกิจการผลิตไฟฟ้า ปฏิบัติตามมาตรการป้องกัน
แก้ไข และติดตามตรวจสอบผลกระทบสิ่งแวดล้อมตามประมวลหลักการปฏิบัติ (Code of Practice: CoP)
