หากผู้จะซื้อผิดนัดการชำระเงินตามที่กำหนดในข้อ4 ผู้จะซื้อยินยอมให้ผู้จะขายเรียกดอกเบี้ยผิดนัดในอัตราร้อยละ 15 ต่อปี ของจำนวนเงินที่ค้างชำระนั้น แต่รวมกันแล้วต้องไม่เกินร้อยละสิบของราคาที่ดินพร้อมสิ่งปลูกสร้าง
