มาตรการนี้เป็นมาตรการที่ใกล้เข้าไปถึงผู้ที่กระทำความผิดมากขึ้นอีก กล่าวคือ ผู้ที่สมรู้ร่วมคิดหรือที่เรียกกันว่า “สมคบ” โดยการตกลงกันตั้งแต่สองคนขึ้นไปเพื่อกระทำความผิดเกี่ยวกับยาเสพติด ผู้นั้นสมคบกันกระทำความผิดเกี่ยวกับยาเสพติด และถ้าได้มีการกระทำความผิดเกี่ยวกับยาเสพติดเพราะเหตุที่ได้มีการสมคบกัน ผู้ที่สมคบจะต้องได้รับโทษเช่นเดียวกับผู้ที่กระทำความผิดนั้น ๆ เรื่องนี้มีบัญญัติไว้ใน พ.ร.บ.มาตรการในการปราบปรามผู้กระทำความผิดเกี่ยวกับยาเสพติด พ.ศ. 2534 มาตรา 8 แต่การนำมาใช้บังคับจริง ๆ นั้นยังมีไม่มาก
