ตลอดระยะเวลาการดำเนินการตามสัญญาฉบับนี้ คู่สัญญาทั้งสองฝ่ายขอให้คำรับรองว่า จะไม่กระทำการใดอันเป็นการเปิดเผยข้อมูลใด ๆ ซึ่งเป็นความลับของอีกฝ่ายหนึ่ง รวมถึงการบอกกล่าวเรื่องการค้าหรือธุรกิจของอีกฝ่ายหนึ่ง หรือระเบียบวิธีปฏิบัติ เทคนิคต่าง ๆ ของอีกฝ่ายหนึ่ง ให้บุคคลอื่นใดได้ล่วงรู้หรือรับทราบไม่ว่าด้วยประการใดทั้งสิ้น เว้นแต่ได้รับอนุญาตจากอีกฝ่ายหนึ่งเป็นลายลักษณ์อักษร
