ในความคิดของผมถ้าพูดถึงหลักพื้นฐาน

ในความคิดของผมถ้าพูดถึงหลักพื้นฐาน 5 ประการของกฎหมายโรมันที่ยังคงใช้อยู่จนถึงทุกวันนี้ ผมก็คงเลือกหลัก ผู้คนมีความเท่าเทียมกันภายใต้กฎหมาย เพราะจะเห็นได้ว่าหลักนี้เป็นหลักสากลที่ในทุกประเทศใช้กัน และก็เป็นหลักพื้นฐานของกฎหมายในแต่ละประเทศก็ว่าได้
อย่างเช่นในประเทศไทยเราก็ใช้หลักนี้เช่นเดียวกัน คือการที่ทุกคนต้องอยู่ภายใต้กฎหมาย และยังรวมถึงพระมหากษัตริย์ที่ทรงเป็นประมุขของประเทศก็ยังทรงอยู่ภายใต้กฎหมายเช่นเดียวกัน ซึ่งหลักนี้ก็คงมีความใกล้เคียงกับคำว่า ความเสมอภาค
ความเสมอภาคก็คือ เป็นหลักพื้นฐานของศักดิ์ศรีของความเป็นมนุษย์ ซึ่งมนุษย์ย่อมได้รับการรับรองและคุ้มครองจากกฎหมายอย่างเท่าเทียมกันในฐานะที่เป็นมนุษย์โดยมิต้องคำนึงถึงคุณสมบัติอื่นๆ อาทิเชื้อชาติ ศาสนา ภาษา ถิ่นกำเนิด เป็นต้น และขณะเดียวกันก็ถือได้ว่าหลักความเสมอภาคนี้เป็นหลักที่ควบคุมมิให้รัฐใช้อำนาจของตนตามอำเภอใจโดยการใช้อำนาจของรัฐแก่กลุ่มบุคคลใดบุคคลหนึ่งรัฐต้องสามารถอธิบายได้ว่าเพราะเหตุใดรัฐจึงกระทำการอันก่อให้เกิดผลกระทบหรือเป็นการให้ประโยชน์แก่บุคคลใดบุคคลหนึ่งนั้นโดยเฉพาะ หากการให้เหตุผลไม่อาจรับฟังได้แสดงว่าการใช้อำนาจของรัฐนั้นเป็นไปตามอำเภอใจ ดังนั้นหลักความเสมอภาคจึงเป็นหลักสำคัญในการรับรองและคุ้มครองสิทธิเสรีภาพของประชาชนและสามารถนำมาตรวจสอบการใช้อำนาจของรัฐไม่ว่าจะเป็นฝ่ายนิติบัญญัติ ฝ่ายบริหาร และฝ่ายตุลาการได้
การที่ทุกคนอยู่ภายใต้กฎหมายในประเทศก็ถือว่าเป็นหลักที่ยังคงอยู่จนถึงทุกวัน เพราะเป็นหลักที่คนในประเทศสามารถปฏิบัติ สามารถรับรู้ได้ การที่ทุกคนอยู่ใต้กฎหมายเดียวกันก็ถือว่าเป็นความเท่าเทียมกันอย่างหนึ่ง และก็ย่อมทำให้คนในประเทศสามารถอยู่ร่วมกันได้โดยปราศจากความไม่ยุติธรรม เพราะถ้าทุกคนไม่อยู่ภายใต้กฎหมาย อาจทำให้เกิดความไม่สงบเรียบร้อยในประเทศ ถ้าทุกคนเอาแต่คิดว่าทำไมเราต้องอยู่ภายใต้กฎหมาย
