2.9.4. วิธีพิเศษ
1. การซื้อโดยวิธีพิเศษ ให้หัวหน้าส่วนราชการแต่งตั้งคณะกรรมการจัดซื้อโดยวิธีพิเศษขึ้นเพื่อดำเนินการดังต่อไปนี้
1.1 ในกรณีเป็นพัสดุจะขายทอดตลาด ให้ดำเนินการซื้อโดยวิธีเจรจาตกลงราคา

1.4 ในกรณีเป็นพัสดุที่ได้ซื้อไว้แล้ว แต่มีความจำเป็นต้องใช้เพิ่มในสถานการณ์ที่จำเป็นหรือเร่งด่วน หรือเพื่อประโยชน์ของส่วนราชากรให้เจรจากับผู้ขายรายเดิมตามสัญญาหรือข้อตกลงซึ่งยังไม่สิ้นสุด ระยะเวลาการส่งมอบ เพื่อขอให้มีการขายพัสดุตามรายละเอียด และราคาที่ต่ำกว่า หรือราคาเดิม ภายใต้เงื่อนไขที่ดีกว่าหรือเงื่อนไขเดิม โดยคำนึงถึงราคาต่อหน่วยตามสัญญาเดิม (ถ้ามี) เพื่อให้บังเกิดผลประโยชน์สูงสุดที่ส่วนราชการจะได้รับ
1.5 ในกรณีเป็นพัสดุที่จำเป็นต้องซื้อโดยตรงจากต่างประเทศ ให้เสนอหัวหน้าส่วนราชการเพื่อติดต่อสั่งซื้อโดยตรงจากต่างประเทศ หรือสืบราคาจากต่างประเทศโดยขอความร่วมมือให้สถานเอกอัครราชทูต หรือส่วนราชการอื่นในต่างประเทศ ช่วยสืบราคา คุณภาพ ตลอดจนรายละเอียด ส่วนราชการซื้อโดยผ่านองค์กรระหว่างประเทศให้ติดต่อกับสำนักงานขององค์การระหว่างประเทศที่มีอยู่ในประเทศโดยตรง เว้นแต่กรณีที่ไม่มีสำนักงานในประเทศ ให้ติดต่อกับสำนักงานในต่างประเทศได้
1.6 ในกรณีเป็นพัสดุที่โดยลักษณะของการใช้งานหรือมีข้อจำกัดทางเทคนิคที่จำเป็นต้องระบุยี่ห้อเป็นการเฉพาะ ให้เชิญผู้ผลิตหรือผู้แทนจำหน่ายพัสดุนั้นโดยตรงมาเสนอราคา หากเห็นว่าราคาที่เสนอนั้นยังสูงกว่าราคาในท้องตลาดหรือราคาที่คณะกรรมการเห็นสมควรให้ต่อรองราคาลงเท่าที่จะทำได้
1.7 ในกรณีเป็นพัสดุที่เป็นดินหรือสิ่งก่อสร้าง ซึ่งจำเป็นต้องซื้อเฉพาะแห่ง ให้เชิญเจ้าของที่ดินโดยตรงมาเสนอราคา หากเห็นว่าราคาที่เสนอยังสูงกว่าราคาในท้องตลาดหรือราคาที่คณะกรรมการเห็นสมควรให้ต่อรองราคาลงเท่าที่จะทำได้
สำหรับการจัดซื้อที่ดินหรือสิ่งก่อสร้างในต่างประเทศ ในกรณีจำเป็นจะติดต่อกับนายหน้า หรือดำเนินการในทำนองเดียวกันตามกฎหมายหรือประเพณีนิยมท้องถิ่น แทนเจ้าของที่ดินก็ได้
