ประวัติศาสตร์กฏหมายเป็นการศึกษาที่มาและวิวัฒนาการของกฎหมาย จุดเริ่มของการกระทำของมนุษย์ การอยู่ร่วมกันของมนุษย์ ทำให้เกิดศีลธรรมประเพณีและศาสนาของมนุษย์ สิ่งเหล่านี้นำไปสู่การสร้างกฏหมายเพื่อใช้ในการควบคุมสังคมให้เกิดความสงบสุข ดังนั้นในฐานะนักกฎหมาย เราจึงควรศึกษาที่มาและวิวัฒนาการประวิติศาสตร์กฏหมาย
การศึกษาประวัติศาสตร์กฎหมาย จะทำให้นักกฏหมายทุกคนเข้าใจวิวัฒนาการของกฏหมาย ซึ่งเป็นประโยชน์ต่อการใช้กฎหมาย นักกฏหมายปัจจุบันได้นำแนวคิดในการร่างกฏหมายมาจากกฏหมายที่ใช้บังคับใน อดีตและในปัจจุบันยังปรากฎให้เห็นถึงการนำแนวคิดในการตีความกฏหมายจากอดีตมาใช้กับปัจจุบัน การเรียนประวัติศาสตร์กฎหมายจะทำให้เราเข้าใจสภาพสังคมไทย ซึ่งจะมีประโยชน์ในการร่างกฏหมายให้มีความสอดคล้องกับนิสัยพื้นฐานและความเป็นจริงของสภาพสังคมไทย นอกจากนี้การศึกษาประวัติศาสตร์กฎหมายจะเป็นการสร้างให้นักกฎหมายเกิดความยุติธรรมและมีจิตใจเป็นนักกฎหมาย เพราะ นักกฎหมายจะมีความเข้าใจและสามารถเห็นความแตกต่างของกระบวนการยุติธรรมตั้งแต่อดีตจนถึงปัจจุบัน จึงทำให้เห็นถึงความบกพร่องและเกิดความรู้สึกอยากปรับปรุงกระบวนการยุติธรรมให้มีความเที่ยงธรรมและเกิดประโยชน์แก่ประชาชนมากที่สุด
แม้ในปัจจุบันจะมีการศึกษาประวัติศาสตร์กฎหมายอย่างกว้างขวาง แต่ก็มีนักกฏหมายสมัยใหม่จำนวนไม่น้อยที่ไม่ให้ความสำคัญและเข้าใจถึงวิวัฒนาการของกฎหมายไทย
