ปัจจุบันสถานภาพของนกแต้วแล้วท้องดำในประเทศไทยน่าเป็นห่วงอย่างยิ่ง ในปี พ.ศ. 2529 เคยพบ 44-45 คู่ แต่ในปี พ.ศ. 2540 เหลือเพียง 9 คู่เท่านั้น ปัจจุบันคาดว่ามีอยู่ประมาณ 13-20 คู่เท่านั้น เป็นหนึ่งในสัตว์สงวน 15 ชนิดของไทย ตาม พรบ.สงวนและคุ้มครองสัตว์ป่า ไอยูซีเอ็นเคยประเมินสถานภาพไว้ว่า ใกล้สูญพันธุ์อย่างยิ่ง (CE) แต่จากการที่การสำรวจพบประชากรของนกชนิดนี้ในพม่ามากขึ้น ในปี 2551 จึงปรับสถานภาพให้ดีขึ้นเล็กน้อยเป็น ใกล้สูญพันธุ์ (EN)
