ตามที่ ธนาคารกรุงเทพ จำกัด (มหาชน) ได้ชำระหนี้แทนท่านตามหนังสือค้ำประกันต่อ กิจการร่วมค้า เอเอสแซด หนังสือค้ำประกันเลขที่ C06215/20407009223 ลงวันที่ 1 สิงหาคม 2550 ซึ่งท่านต้องชำระหนี้แก่ธนาคาร ณ วันที่ 15 กันยายน 2559 คงค้างชำระหนี้เป็นต้นเงิน 48,853,600.00 บาท และดอกเบี้ย 14,093,928.98 บาท รวมเป็นจำนวนเงินทั้งสิ้น 62,947,528.98 บาท

เนื่องจากท่านผิดนัดชำระหนี้ตามหนังสือค้ำประกันดังกล่าว และปรากฎว่าท่านมีบัญชีเงินฝากกระแสรายวันอยู่กับธนาคารกรุงเทพ จำกัด (มหาชน) ณ วันที่ 15 กันยายน 2559 สาขาเขตอุตสาหกรรมกบินทร์บุรี บัญฃีเลขที่ 722-3-00037-8 ชื่อบัญชีบริษัท ซูบลิน (ประะเทศไทย)จำกัด เป็นจำนวนเงิน 167,561.82 บาท

ฉะนั้น โดยหนังสือฉบับนี้ ธนาคารกรุงเทพ จำกัด (มหาชน) จึงได้ดำเนินการหักกลบลบหนี้ตามสัญญาดังกล่าวข้างต้น กับเงินฝากของท่านโดยนำเข้าหักชำระบัญชีสินเชื่อเลขที่ 04-215-07100-018 ชื่อบัญฃีกิจการร่วมค้า เอเอสแซด เป็นเงินจำนวน 167,561.82 บาท ซึ่งเมื่อหักกลบลบหนี้แล้ว ปรากฎว่า ณ วันที่ 15 กันยายน 2559 กิจการร่วมค้า เอเอสแซด ยังคงมีภาระหนี้ค้างชำระอยู่กับธนาคารเป็นต้นเงินและดอกเบี้ย รวมเป็นจำนวนเงินทั้งสิ้น 62,779,967.16 บาท
