บทคัดย่อ
การศึกษาวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสำนวนการสั่งใช้ รูปแบบของสำนวนการสั่งใช้ และศึกษาภาคบังคับใช้เชิงนิติศาสตร์มูลฐานและการตีความกฎนิติศาสตร์อิสลามของสำนวนสั่งใช้ในซูเราะห์ อัลนิสาอฺ การศึกษาวิจัยครั้งนี้เป็นการศึกษาวิจัยคุณภาพ เชิงสำรวจ ด้วยการสืบค้นหาสำนวนสั่งใช้และตีความกฎนิติศาสตร์อิสลามของสำนวนสั่งใช้ในซูเราะห์ อัลนิสาอฺ โดยวิเคราะห์ข้อมูลเชิงพรรณนา ผลการวิจัยพบว่า (1) สำนวนสั่งใช้ในกฎหมายอิสลามเป็นการสั่งใช้ของผู้อยู่ในระดับที่สูงกว่า ซึ่งผู้สั่งใช้คือ พระองค์อัลลอฮฺและศาสนทูตของพระองค์ ศ็อลฯ ซึ่งคำสั่งใช้ทางกฎหมายอิสลามนั้นไม่สามารถละเลย หย่อนยานได้เลยตามทัศนะของนักกฎหมายและนิติศาสตร์มูลฐานอิสลาม (2) สำนวนการสั่งใช้ที่ปรากฏในซูเราะห์ อัลนิสาอฺนั้นจะมาในรูปประโยคคำสั่งและประโยคบอกเล่า ส่วนประโยคคำสั่งจะมี 4 รูป กล่าวคือ กริยาสั่งใช้ (فعل الأمر) กริยาปัจจุบันกาลที่มีพยัญชนะ ลามที่บ่งบอกถึงการสั่งใช้ (والمضارع المقرون بلام الأمر) นามกริยาที่บ่งบอกถึงการสั่งใช้ (واسم فعل الأمر) และอาการนามทีบ่งบอกถึงการสั่งใช้ (والمصدر النائب عن فعل الأمر) ส่วนประโยคบอกเล่าเป็นประโยคที่บ่งบอกถึงการสั่งใช้ (3) สำหรับสำนวนการสั่งใช้นั้น ความหมายเดิม คือ การบังคับจำต้องปฏิบัติไม่สามารถเลี่ยงได้ นักกฎหมายและนิติศาสตร์มูลฐานอิสลามได้ศึกษาพบว่า กฎเดิมของสำนวนการสั่งใช้นั้นเป็นการบังคับจำต้องปฏิบัติตาม บางครั้งสำนวนการสั่งใช้จะให้ความหมายหรือตีความว่าให้กฎนัยยะอย่างอื่นที่มิใช่กฎเดิมซึ่งเป็นการบังคับตามที่ปรากฏในซูเราะห์ อัลนิสาอฺ อาทิเช่น ภาคส่งเสริม(ซุนนัต)ซึ่งหากปฏิบัติตามแล้วจะได้รับผลบุญ หากไม่ปฏิบัติก็ไม่ได้ผลบุญ และภาคอิสระ(ญะวาส)สามารถเลือกที่จะปฏิบัติตามหรือละทิ้งไม่ปฏิบัติตามคำสั่งใช้ดังกล่าว
