วันที่ 20 พฤศจิกายน พ.ศ. 2556 ศาลรัฐธรรมนูญวินิจฉัยว่า การแก้ไขเพิ่มเติมรัฐธรรมนูญ ว่าด้วยที่มาของสมาชิกวุฒิสภา ขัดต่อรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 แต่พรรคเพื่อไทยปฏิเสธคำวินิจฉัยนี้ โดยให้เหตุผลว่า ศาลรัฐธรรมนูญก้าวล่วงเขตอำนาจของรัฐสภา ในอันที่จะแก้ไขรัฐธรรมนูญตามกระบวนการ รวมทั้งมีสมาชิกพรรคเพื่อไทย และนักวิชาการส่วนหนึ่ง ให้ความเห็นก่อนหน้านี้ว่า ศาลรัฐธรรมนูญละเมิดพระราชอำนาจ เนื่องจากร่างแก้ไขดังกล่าวนำขึ้นทูลเกล้าฯ ถวายไปแล้วตั้งแต่วันที่ 1 ตุลาคม 2556 จำนวนผู้ประท้วงต่อต้านรัฐบาลเพิ่มขึ้นในช่วงสุดสัปดาห์เดียวกัน[8] ทั้งนี้รัฐบาลชี้แจงว่าไม่สามารถขอร่างกฎหมายดังกล่าวคืนได้[9] ทว่าต่อมาในวันที่ 8 ธันวาคม 2556 นายกรัฐมนตรีขอพระราชทาน ถอนร่างรัฐธรรมนูญดังกล่าว พร้อมทั้งขอพระราชทานอภัยโทษ หากระคายเบื้องพระยุคลบาท[10] ขณะที่ นปช.จัดการชุมนุมเพื่อตอบโต้การต่อต้านรัฐบาลขึ้นที่ราชมังคลากีฬาสถานตั้งแต่วันที่ 24 พฤศจิกายน พ.ศ. 2556 ถึงเช้าวันที่ 1 ธันวาคม พ.ศ. 2556 ในวันที่ 25 พฤศจิกายน พ.ศ. 2556 กลุ่มผู้ประท้วงฝ่ายสุเทพ ก็เริ่มปิดล้อมและพยายามบุกรุกเข้ายึดอาคารสถานที่ราชการหลายแห่ง เพื่อหวังจะบังคับให้ปิดทำการ โดยมีเหตุรุนแรงเกิดขึ้นอยู่บ้าง ที่สำคัญคือ การปะทะกันระหว่างกลุ่มสนับสนุนและต่อต้านรัฐบาลบริเวณมหาวิทยาลัยรามคำแหง ตลอดทั้งวันที่ 30 พฤศจิกายน ต่อเนื่องถึงเช้าวันที่ 1 ธันวาคม จนมีผู้เสียชีวิต 4 คน และบาดเจ็บ 57 คน[11][12]
