ที่มาของกฎหมายอิสลามถูกเรียกว่า หลั

ที่มาของกฎหมายอิสลามถูกเรียกว่า หลักฐานทางศาสนบัญญัติ (اَلأَدِلَّةُ الشَّرْعِيَّةُ)      หรือ หลักมูลฐาน  (اَلأُصُوْلُ)  ซึ่งนักกฎหมายอิสลามส่วนใหญ่มีความเห็นตรงกันว่ามี  4  ประการ  คือ

1.  อัล-กุรฺอาน  (اَلْقُرْآن)

2.  อัล-หะดีษ  (اَلْحَدِيْثُ)

3.  อัล-อิจญฺมาอฺ  (اَلإِجْمَاعُ)

สามประการนี้เรียกว่า  หลักฐานอันเป็นตัวบทที่มีการรายงานสืบเนื่องกันมา (اَلأَدِلَّةُ النَّقْلِيَّةُ) 

4.  อัล-กิยาส   (اَلْقِيَاسُ)  หลักข้อนี้จัดอยู่ในหมวดหลักฐานที่ใช้การวิเคราะห์ทางสติปัญญา  (اَلأَدِلَّةُ الْعَقْلِيَّةُ)  ซึ่งนักกฎหมายอิสลามได้ผนวกประเภทของหลักฐานในหมวดนี้เอาไว้แตกต่างกัน  เช่น  อัล-อิสติหฺสาน  อัล-อิสติสหาบฺ  อัลอุรฺฟ และอัล-มะศอลิฮุลมุรฺสะละฮฺ  เป็นต้น

นักวิชาการเรียกที่มาของกฎหมายอิสลามทั้ง  4  ประการนี้ว่า     หลักฐานปฐมภูมิ              (اَلأَدِلَّةُ الأَسَاسِيَّةُ)     และเรียกประเภทอื่น ๆ ที่ถูกจัดอยู่ในหมวดของหลักฐานที่ใช้การวิเคราะห์ทางสติปัญญาว่า  หลักฐานสืบเนื่อง  (اَلأَدِلَّةُ التَّابِعِيَّةُ)  หรือ  หลักฐานทุติยภูมินั่นเอง
