บทคัดย่อ
การทำหนังสือแสดงเจตนาและการการุณยฆาตล้วนเป็นปรากฎการณ์เรื่องใหม่ของประเทศไทยและยังไม่เป็นที่ยอมรับของคนทั่วไป นอกจากนี้ยังมีแพทย์จำนวนไม่น้อยที่มีความสับสนว่าอย่างไรคือการทำหนังสือแสดงเจตนา อย่างไรคือการการุณยฆาต เพื่อเป็นการแก้ไขความเข้าใจคลาดเคลื่อนดังกล่าวประเทศไทยจึงได้มีการออกพระราชบัญญัติรองรับการทำหนังสือแสดงเจตนา ซึ่งปรากฏอยู่ในมาตรา12 แห่งพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ.2550 บัญญัติว่า บุคคล มีสิทธิทำหนังสือแสดงเจตนาไม่ประสงค์จะรับบริการสาธารณสุขที่เป็นไปเพียงเพื่อยืดการตายในวาระสุดท้ายของชีวิตตน หรือเพื่อยุติการทรมานจากการเจ็บป่วยได้ ดังนั้นอาจกล่าวได้ว่ามาตรา12 นั้น หมายถึง การที่ผู้ป่วยไม่ประสงค์จะเข้ารับการรักษาทางการแพทย์ใดๆ เพื่อเป็นการยืดชีวิตนั้นเอง ซึ่งการแสดงเจตนาดังกล่าวนั้นสามารถทำได้โดยแสดงเจตนาดังกล่าวเป็นหนังสือหรือด้วยวาจาย่อมสมบูรณ์ ระบุว่าหากผู้ป่วยอยู่ในวาระสุดท้ายและการรักษาไม่สามารถรักษาให้หายขาดได้ขอให้แพทย์ยุติการรักษาพยาบาลหรือไม่ต้องใช้เครื่องมือในการช่วยชีวิตใดๆ ซึ่งกรณีดังกล่าวนี้ถือว่าเป็นการแสดงเจตนาโดยชัดแจ้งหรือเรียกว่าหนังสือแสดงเจตนา แพทย์ผู้ที่ทำการรักษาจะใช้วิธีการรักษาแบบประคับประคองตามอาการเจ็บป่วยของโรคเพียงเพื่อมิให้ขัดต่อหลักมนุษยธรรมจนกระทั่งผู้ป่วยถึงแก่ ความตายไปตามวิถิทางธรรมชาติและการที่แพทย์กระทำดังกล่าวนี้ไม่ถือว่าเป็นการการุณยฆาตและการกระทำใดๆที่แพทย์ได้ทำลงไปนั้นย่อมไม่ต้องรับผิดตามกฎหมายอาญาและกฎหมายแพ่ง ส่วนสิทธิการตายตามมาตรา 24 แห่งพระราชบัญญัติสุขภาพแห่งชาติ พ.ศ.2550 บัญญัติว่า บุคคล มีสิทธิแสดงความจำนงเกี่ยวกับวิธีการรักษาพยาบาลหรือปฏิเสธการรักษาที่เป็นไปเพื่อการยืดชีวิตในวาระสุดท้ายในชีวิตของตนเอง เพื่อการตายอย่างสงบและมีศักดิ์ศรีของความเป็นมนุษย์ โดยมีคำชี้แจงว่าเพื่อให้บุคคลมีสิทธิเลือกตายอย่างสงบ และมีศักดิ์ศรีของความเป็นมนุษย์ ในบั้นปลายของชีวิต โดยไม่ยืดชีวิต หรือถูกแทรกแซงการตายเกินความจำเป็น และเพื่อไม่ให้เป็นภาระทุกๆ ด้าน โดยให้มีสิทธิแสดงความจำนงล่วงหน้า หรืออาจกล่าวได้ว่าเป็นการทำหนังสือแสดงเจตนานั่นเอง
