ข้อ 1. คำนิยาม
ในสัญญานี้

“การบำรุงรักษา” หมายความรวมถึงการซ่อมแซมแก้ไขและเปลี่ยนแปลงส่วนประกอบที่เกี่ยวข้องกับเครื่องจักรกล เช่น การซ่อมบำรุง การเปลี่ยนอะไหล่หรือเปลี่ยนอุปกรณ์ตามกำหนดเวลา ฯลฯ ตลอดจนการปรับแต่งเครื่องเพื่อให้เครื่องจักรกลอยู่ในสภาพที่สามารถใช้งานได้ดีตลอดเวลา
“การซ่อมแซมแก้ไข” หมายความถึงการซ่อมแซมแก้ไขส่วนที่ชำรุดบกพร่องทั้งปวง รวมทั้ง การซ่อมแซมแก้ไขเล็กน้อย

ข้อ 3. การประกันภัยเครื่องจักรกลที่เช่า
ผู้ให้เช่าจะต้องประกันภัยเครื่องจักรกลที่ให้เช่าแบบประเภทชั้นหนึ่งอย่างต่อเนื่องตลอดอายุสัญญาเช่าไว้กับบริษัทประกันภัยที่ผู้เช่าให้ความเห็นชอบและผู้ให้เช่าจะต้องประกันภัยเครื่องจักรกลที่เช่าตามพระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ พ.ศ.2535
ทั้งนี้ ผู้ให้เช่าจะต้องเป็นผู้ชำระค่าเบี้ยประกันภัยเอง และมอบสำเนาหลักฐานการเอา
ประกันภัยดังกล่าวให้แก่ผู้เช่าในวันที่ผู้เช่ารับมอบเครื่องจักรกล และทุกครั้งในวันที่มีการต่ออายุสัญญาหรือทำสัญญาประกันภัยใหม่ตลอดอายุสัญญาเช่าด้วย

ข้อ 4. การจดทะเบียนและเสียภาษีประจำปีเครื่องจักรกลที่เช่า
ผู้ให้เช่าจะต้องดำเนินการจดทะเบียนและเสียภาษีประจำปีเครื่องจักรกลที่เช่าตามกฎหมาย
ให้แล้วเสร็จก่อนวันครบกำหนดส่งมอบเครื่องจักรกลที่เช่าตามสัญญาข้อ 9 ตลอดจนดำเนินการเสียภาษี
ประจำปีให้ทันกำหนดในปีต่อๆ ไปด้วย

หากเอกสารแนบท้ายสัญญานี้ขัดหรือแย้งกัน ให้เป็นสิทธิของผู้เช่าวินิจฉัยชี้ขาด และให้คำวินิจฉัยชี้ขาดดังกล่าวเป็นที่สุด โดยผู้ให้เช่าไม่มีสิทธิเรียกร้องค่าเสียหายใดๆ จากผู้เช่า

ข้อ 7. การชำระค่าเช่า

ผู้เช่า ผู้เช่าจะไม่จ่ายค่าเช่าในวันนั้น โดยผู้เช่าจะแจ้งเป็นหนังสือให้ทราบ และมีสิทธิหักค่าเช่าในวันดังกล่าวนั้นออกจากค่าเช่าประจำเดือนได้ ทั้งนี้โดยวิธีการคำนวณเช่นเดียวกับที่ระบุในวรรคก่อน
