สัญญาเช่า

สัญญาเช่าทำขึ้น เมื่อวันที่ เดือน พ.ศ. ณ บ้านเลขที่ 171 ถนนสุขุมวิท แขวงคลองเตยเหนือ เขตวัฒนา กรุงเทพมหานคร ระหว่าง
ก. บริษัท ชวริน จำกัด โดยนางสุวรรณี ทั่งสัมพันธ์ และนางสาวชวนุช ทั่งสัมพันธ์ กรรมการ
ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ผู้ให้เช่า” ฝ่ายหนึ่งกับ

ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ผู้เช่า” อีกฝ่ายหนึ่ง
ทั้งสองฝ่ายตกลงทำสัญญากัน มีข้อความดังต่อไปนี้
ข้อ 1. ผู้ให้เช่าตกลงให้เช่า และผู้เช่าตกลงเช่า ห้องเลขที่ บริเวณ

สถานที่เช่านี้ ผู้ให้เช่าได้จัดสิ่งของต่าง ๆ ประกอบด้วยวัสดุ อุปกรณ์ ตามแบบ และมาตราฐานของผู้ให้เช่า ซึ่งถือว่าเป็นกรรมสิทธิ์ของผู้ให้เช่า
ข้อ 2. ผู้ให้เช่า และผู้เช่า ตกลงคิดค่าเช่าในอัตราเดือนละ บาท ( บาทถ้วน)ต่อห้อง รวม 1 (หนึ่ง) ห้อง เป็นเงินค่าเช่าเดือนละ บาท ( บาทถ้วน) และค่าบริการส่วนกลาง (อาทิเช่น ค่าดูแลรักษาความสะอาดเรียบร้อยพื้นที่ส่วนรวม ค่าบริการสิ่งอำนวยความสะดวกต่าง ๆ ในพื้นที่ส่วนรวม เป็นต้น) ในอัตราเดือนละ บาท ( บาทถ้วน) ต่อห้อง รวม 1 (หนึ่ง) ห้อง เป็นเงินค่าบริการส่วนกลางเดือนละ บาท ( บาทถ้วน)
ข้อ 3. ผู้ให้เช่า และผู้เช่า ตกลงกันว่า การเช่าตามสัญญานี้ มีกำหนดระยะเวลา 1 (หนึ่ง) ปี
โดยเริ่มสัญญา ตั้งแต่วันที่ เดือน พ.ศ.
ถึงวันที่ เดือน พ.ศ.
โดยจะประกอบกิจการค้าประเภท
ใช้ชื่อร้านว่า
ข้อ 4. การชำระค่าเช่า ผู้เช่าตกลงชำระค่าเช่าล่วงหน้าให้แก่ผู้ให้เช่าเป็นรายเดือน โดยชำระภายในวันที่ 25 ของเดือนทุกเดือน ณ ที่ทำการของผู้ให้เช่า
ส่วนค่าน้ำประปา ค่ากระแสไฟฟ้า ค่าแอร์ และค่าโทรศัพท์ ผู้เช่าจะต้องเสียเพิ่มขึ้น ตามอัตราที่กล่าวไว้ในหนังสือรับรองหมายเลข 1 ท้ายสัญญานี้ และให้ถือเป็นส่วนหนึ่งแห่งสัญญานี้ด้วย
ข้อ 5. เพื่อเป็นการประกันการเช่าตามสัญญานี้ ผู้เช่าตกลงวางเงินมัดจำการเช่า เป็นเงิน บาท ( บาทถ้วน) เพื่อเป็นการประกันความเสียหายหรือความสูญเสียใด ๆ ที่ผู้ให้เช่าอาจได้รับเนื่องจากการไม่ปฏิบัติตามสัญญาในส่วนของผู้เช่าตามที่กำหนดไว้ในสัญญานี้ เงินมัดจำนี้จะคืนให้ผู้เช่าหลังจากสัญญาเช่าได้สิ้นสุดตามระยะเวลาของสัญญา และผู้เช่าได้ส่งมอบสถานที่ให้เช่าแล้ว ทั้งนี้โดยที่ผู้เช่าจะต้องไม่ได้ปฏิบัติผิดสัญญาเช่ามา

ก่อน เงินมัดจำที่วางไว้นี้จะนำไปใช้แทนการชำระค่าเช่าล่วงหน้าไม่ได้ ใช้เป็นข้ออ้างเพื่อไม่ชำระค่าเช่ารายเดือนตามที่กำหนดไว้ในสัญญานี้ไม่ได้
ในกรณีที่ผู้เช่าผิดสัญญา และผู้ให้เช่าใช้สิทธิบอกเลิกการเช่าและหรือกรณีที่ผู้เช่าขอเลิกเช่าก่อนครบกำหนดระยะเวลา ผู้เช่ายินยอมให้ผู้ให้เช่าริบเงินมัดจำจากการเช่าดังกล่าวข้างต้นได้ทันทีที่สัญญานี้จะต้องระงับลง โดยไม่ตัดสิทธิที่ผู้ให้เช่าจะเรียกร้องค่าเสียหายตามกฎหมายอีกส่วนหนึ่งต่างหาก
ข้อ 6. ผู้เช่าสัญญาว่า
6.1 ผู้เช่าจะใช้สถานที่ เพื่อประกอบการค้า เท่านั้น จะไม่ใช้สถานที่เช่าไปประกอบการค้าประเภทอื่น เว้นแต่จะได้รับคำยินยอมจากผู้ให้เช่าเป็นลายลักษณ์อักษร และผู้เช่าตกลงเป็นผู้ขอใบอนุญาตในการขายอาหาร ใบอนุญาตสะสมอาหาร ใบอนุญาตจำหน่ายสุรา ใบอนุญาตจำหน่ายบุหรี่ รวมถึงใบอนุญาตต่าง ๆ ที่เกี่ยวพันกับการประกอบธุรกิจร้านอาหารของผู้เช่าภายใต้ชื่อของผู้เช่า และผู้เช่าต้องดำเนินธุรกิจให้ถูกต้องตามกฎหมาย กฎระเบียบ ข้อบังคับของทางราชการโดยเคร่งครัด
6.2 ผู้เช่าสัญญาว่า จะไม่ดำเนินธุรกิจ หรือชักนำ หรือชักชวน หรือกระทำด้วยวิธีอื่นใด อันเป็นการแข่งขันกับโรงแรมหรือธุรกิจหรือกิจการใด ๆ ของผู้ให้เช่า รวมถึงการขายห้องพัก การรับจองห้องพัก ทั้งของโรงแรมของผู้ให้เช่า และโรงแรมอื่น ๆ ภายในสถานที่เช่า
6.3 ผู้เช่าสัญญาว่าจะเปิดร้านที่เช่าดำเนินธุรกิจทุกวัน
6.4 ผู้เช่าต้องใช้สถานที่เช่าด้วยตนเอง ห้ามนำไปให้บุคคลอื่นเช่าช่วง หรือเข้าครอบครอง หรือทำประโยชน์ใด ๆ ในสถานที่เช่าไม่ว่าทั้งหมดหรือบางส่วนไม่ว่าจะเป็นการประจำหรือชั่วคราว ตลอดจนห้ามมิให้โอนสิทธิการเช่าให้แก่บุคคลอื่น เว้นแต่ จะได้รับความยินยอมเป็นลายลักษณ์อักษรจากผู้ให้เช่า และเมื่อได้รับความยินยอมแล้ว ผู้เช่าจะต้องเสียค่าธรรมเนียมในการโอน หรือเช่าช่วงในอัตราห้องละ 10,000.- บาท (หนึ่งหมื่นบาทถ้วน)
6.5 ผู้เช่าจะต้องไม่ใช้สถานที่เช่าเป็นที่อยู่อาศัย หรือพักแรม ตลอดจนห้ามจัดเตรียมประกอบอาหารไม่ว่าจะจัดทำเพื่อตนเองหรือผู้อื่น
6.6 ผู้เช่าจะต้องดูแลรักษาสถานที่เช่าให้สะอาด เรียบร้อย สวยงาม และรับผิดชอบในการกำจัดขยะ และสิ่งปฏิกูล ตลอดจนสิ่งโสโครกในบริเวณสถานที่เช่า ด้วยค่าใช้จ่ายของผู้เช่าเอง
6.7 ผู้เช่าต้องไม่ใช้สถานที่เช่าเก็บ หรือประกอบการ หรือจัดทำกิจกรรมที่ผิดกฎหมาย หรือผิดศีลธรรมอันดี กิจกรรมอันเป็นอันตรายต่อสุขภาพอนามัย เป็นที่รังเกียจ และ/หรือ กิจกรรมที่ก่อให้เกิดความเดือดร้อนรำคาญแก่ผู้เช่าอื่น และ/หรือผู้ให้เช่า
6.8 ผู้เช่าสัญญาว่าจะจัดสร้างสถานที่ติดตั้งแก๊สหุงต้มให้มิดชิดปลอดภัย มีอากาศถ่ายเทได้สะดวก รวมถึงต้องจัดทำถังดักไขมัน ซึ่งจะต้องจัดสร้างให้ตรงตามแบบที่ทางราชการกำหนด โดยผู้เช่าจะต้องส่งแบบแปลนการจัดทำสถานที่ติดตั้งแก๊สหุงต้ม และถังดักไขมันให้ผู้ให้เช่าพิจารณาอนุญาตเสียก่อนจึงจะดำเนินการจัดทำสถานที่ติดตั้งแก๊สหุงต้ม และถังดักไขมันได้
