ประกาศกรมสวัสดิการและคุ้มครองแรงงาน
เรื่อง หลักเกณฑ์และวิธีการทดสอบส่วนประกอบและอุปกรณ์ของปั้นจั่น
โดยที่กฎกระทรวงกําหนดมาตรฐานในการบริหารและการจัดการด้านความปลอดภัย อาชีวอนามัย
และสภาพแวดล้อมในการทํางานเกี่ยวกับเครื่องจักร ปั้นจั่น และหม้อน้ํา พ.ศ. ๒๕๕๒ กําหนดให้
นายจ้างต้องจัดให้มีการทดสอบส่วนประกอบและอุปกรณ์ของปั้นจั่นปีละไม่น้อยกว่าหนึ่งครั้งตามประเภท
และลักษณะของงาน ตามหลักเกณฑ์และวิธีการที่อธิบดีประกาศกําหนด
อาศัยอํานาจตามความในข้อ ๕๐ แห่งกฎกระทรวงกําหนดมาตรฐานในการบริหารและการ
จัดการด้านความปลอดภยั อาชีวอนามัย และสภาพแวดล้อมในการทํางานเกี่ยวกับเครื่องจักร ปั้นจั่น
และหม้อน้ํา พ.ศ. ๒๕๕๒ อันเป็นกฎหมายที่มีบทบัญญัติบางประการเกี่ยวกับการกําจัดสิทธิ
และเสรีภาพของบุคคล ซึ่งมาตรา ๒๙ ประกอบกับมาตรา ๓๓ มาตรา ๔๑ และมาตรา ๔๓
ของรัฐธรรมนูญแห่งราชอาณาจักรไทยบัญญัติให้กระทําได้โดยอาศัยอํานาจตามบทบัญญัติแห่งกฎหมาย
อธิบดีกรมสวัสดิการและคุ้มครองแรงงานจึงออกประกาศไว้ ดังต่อไปนี้
ข้อ ๑ ประกาศนี้เรียกว่า “ประกาศกรมสวัสดิการและคุ้มครองแรงงาน เรื่อง หลักเกณฑ์
และวิธีการทดสอบส่วนประกอบและอุปกรณ์ของปั้นจั่น”
ข้อ ๒ ประกาศนี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป
ข้อ ๓ ให้นายจ้างจัดให้มีการทดสอบส่วนประกอบและอุปกรณ์ของปั้นจั่นตามประเภท
และลักษณะของงาน ดังนี้
(๑) ปั้นจั่นที่ใช้ในงานก่อสร้าง
(ก) ขนาดพิกัดยกอย่างปลอดภัยตามที่ผู้ผลิตกําหนดไม่เกิน ๓ ตัน ต้องจัดให้มีการ
ทดสอบส่วนประกอบและอุปกรณ์ของปั้นจั่นทุก ๆ ๖ เดือน
(ข) ขนาดพิกัดยกมากกว่า ๓ ตันขึ้นไป ต้องจัดให้มีการทดสอบส่วนประกอบและ
อุปกรณ์ของปั้นจั่นทุก ๆ ๓ เดือน
(ค) ที่ไม่มีรายละเอียดขนาดพิกัดยกอย่างปลอดภัยตามที่ผู้ผลิตกําหนดในการทดสอบ
ให้นายจ้างทดสอบโดยใช้ขนาดพิกัดยกตามที่วิศวกรกําหนด
(๒) ปั้นจั่นที่ใช้งานอื่น ๆ
(ก) ขนาดพิกัดยกอย่างปลอดภัยตามที่ผู้ผลิตกําหนดต้ังแต่ ๑ ตัน แต่ไม่เกิน ๓ ตัน
ต้องจัดให้มีการทดสอบส่วนประกอบและอุปกรณ์ของปั้นจั่นปีละหนึ่งครั้ง
(ข) ขนาดพิกัดยกมากกว่า ๓ ตัน แต่ไม่เกิน ๕๐ ตัน ต้องจัดให้มีการทดสอบ
ส่วนประกอบและอุปกรณ์ของปั้นจั่นทุก ๆ ๖ เดือน
(ค) ขนาดพิกัดยกมากกว่า ๕๐ ตันขึ้นไป ต้องจัดให้มีการทดสอบส่วนประกอบ
และอุปกรณ์ของปั้นจั่นทุก ๆ ๓ เดือน
