ทั้งนี้ พ.ร.บ. ฉบับดังกล่าว มีสาระส

ทั้งนี้ พ.ร.บ. ฉบับดังกล่าว มีสาระสำคัญคือ เพื่อคุ้มครองสัตว์มิให้ถูกทารุณกรรม และเจ้าของจะต้องจัดสวัสดิภาพให้สัตว์มีความเป็นอยู่ที่เหมาะสมกับสภาวะของสัตว์แต่ละชนิด พร้อมกำหนดบทลงโทษไว้ดังนี้

ผู้ที่กระทำการอันเป็นการทารุณกรรมสัตว์โดยไม่มีเหตุอันสมควร ต้องระวางโทษจําคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 40,000 บาท หรือทั้งจําทั้งปรับ

เจ้าของสัตว์ หรือผู้ใดที่ไม่จัดสวัสดิภาพสัตว์ให้เหมาะสมกับหลักเกณฑ์ วิธีการ และเงื่อนไขที่รัฐมนตรีประกาศกําหนดตามมาตรา 22 มาตรา 24 หรือฝ่าฝืนมาตรา 23 ต้องระวางโทษปรับไม่เกิน 40,000 บาท

ทั้งนี้ ศาลมีอำนาจสั่งห้ามมิให้เจ้าของหรือผู้กระทำความผิดนั้นครอบครองสัตว์ หากเห็นว่าสัตว์นั้นอาจจะถูกทารุณกรรมหรือได้รับการจัดสวัสดิภาพสัตว์ที่ไม่เหมาะสมอีก โดยจะมอบให้หน่วยงานของรัฐหรือบุคคลที่เห็นสมควรเป็นผู้ครอบครองหรือดูแลสัตว์นั้นต่อไป

อย่างไรก็ตาม ใน พ.ร.บ. ดังกล่าว ยังระบุถึงกรณีที่ไม่ถือเป็นการทารุณกรรมสัตว์ ตามมาตรา 21 ดังนี้

1. การฆ่าสัตว์เพื่อใช้เป็นอาหาร ทั้งนี้ เฉพาะสัตว์เลี้ยงเพื่อใช้เป็นอาหาร
2. การฆ่าสัตว์ตามกฎหมายว่าด้วยการควบคุมการฆ่าสัตว์และจําหน่ายเนื้อสัตว์
3. การฆ่าสัตว์เพื่อควบคุมโรคระบาดตามกฎหมายว่าด้วยโรคระบาดสัตว์
4. การฆ่าสัตว์ในกรณีที่สัตวแพทย์เห็นว่าสัตว์ป่วย พิการ หรือบาดเจ็บและไม่สามารถเยียวยา หรือรักษาให้มีชีวิตอยู่รอดได้โดยปราศจากความทุกข์ทรมาน
5. การฆ่าสัตว์ตามพิธีกรรมหรือความเชื่อทางศาสนา
6. การฆ่าสัตว์ในกรณีที่มีความจําเป็นเพื่อป้องกันอันตรายแก่ชีวิตหรือร่างกายของมนุษย์ หรือสัตว์อื่น หรือป้องกันความเสียหายที่จะเกิดแก่ทรัพย์สิน
7. การกระทําใด ๆ ต่อร่างกายสัตว์ซึ่งเข้าลักษณะของการประกอบวิชาชีพการสัตวแพทย์ โดยผู้ประกอบวิชาชีพการสัตวแพทย์หรือผู้ซึ่งได้รับยกเว้นให้กระทําได้โดยไม่ต้องขึ้นทะเบียนและได้รับใบอนุญาตเป็นผู้ประกอบวิชาชีพการสัตวแพทย์จากสัตวแพทยสภาตามกฎหมายว่าด้วยวิชาชีพการสัตวแพทย์หน้า 10 เล่ม 131 ตอนที่ 87 ก ราชกิจจานุเบกษา 26 ธันวาคม 2557
8. การตัด หู หาง ขน เขา หรืองาโดยมีเหตุอันสมควรและไม่เป็นอันตรายต่อสัตว์ หรือการดํารงชีวิตของสัตว์
9. การจัดให้มีการต่อสู้ของสัตว์ตามประเพณีท้องถิ่น
10. การกระทําอื่นใดที่มีกฎหมายกําหนดให้สามารถกระทําได้เป็นการเฉพาะ
11. การกระทําอื่นใดที่รัฐมนตรีประกาศกําหนดโดยความเห็นชอบของคณะกรรมการ
