เหตุปฏิเสธไม่ให้บุคคลเข้าพักในโรงแรม
พระราชบัญญัติโรงแรม พ.ศ. ๒๕๔๗ กำหนดนิยาม “โรงแรม” ไว้ โดยองค์ประกอบหนึ่ง คือเป็นสถานที่พักของคนเดินทางหรือบุคคลอื่นใด ซึ่งโดยนัยแล้วต้องรับบุคคลทั่วไปเข้าพักโดยไม่อาจเลือกปฏิบัติได้ แต่อย่างไรก็ตามเพื่อเป็นการคุ้มครองสิทธิและประโยชน์ของผู้ประกอบธุรกิจโรงแรมและผู้เข้าพักอื่น จึงได้กำหนดข้อยกเว้นให้ผู้จัดการสามารถปฏิเสธผู้เข้าพักได้ด้วยเหตุ ดังนี้ (มาตรา ๓๙)
(๑) มีเหตุอันควรสงสัยได้ว่าบุคคลนั้นจะเข้าไปหลบซ่อน มั่วสุม หรือกระทำการใด อันเป็นความผิดอาญาขึ้นในโรงแรม หรือก่อให้เกิดความรำคาญแก่ผู้พักอื่นในโรงแรม
(๒) มีเหตุอันควรเชื่อได้ว่าบุคคลนั้นไม่สามารถจ่ายค่าห้องพักได้
(๓) มีเหตุอันควรเชื่อได้ว่าบุคคลนั้นเป็นโรคติดต่ออันตรายหรือโรคติดต่อตามกฎหมายว่าด้วยโรคติดต่อ
(๔) มีเหตุอันสมควรประการอื่นตามที่คณะกรรมการประกาศกำหนด
ในกรณีมีเหตุอันควรเชื่อได้ว่าบุคคลนั้นเป็นโรคติดต่ออันตรายหรือโรคติดต่อตามกฎหมายว่าด้วยโรคติดต่อ ถ้าผู้จัดการรับบุคคลนั้นเข้าพักจะต้องแจ้งให้เจ้าพนักงานสาธารณสุขหรือพนักงานเจ้าหน้าที่ตามกฎหมายว่าด้วยโรคติดต่อทราบด้วย
