ปัจจุบันโลกของเทคโนโลยีสมัยใหม่ เข้ามามีบทบาทในสังคมไทย ไม่ว่าเด็กหรือผู้ใหญ่ ทุกเพศ ทุกวัย จนอาจกล่าวได้ว่าเทคโนโลยีเป็นส่วนหนึ่งของชีวิตประจำวันไปแล้ว นั่นอาจหมายถึง คอมพิวเตอร์ และโทรศัพท์มือถือ เป็นเครื่องมือในการส่งข้อมูลข่าวสารอย่างแผ่หลายเพราะอินเทอร์เน็ตคือเครือข่ายคอมพิวเตอร์ที่เชื่อมต่อกันเป็นจำนวนมากครอบคลุมไปทั่วโลก โดยอาศัยโครงสร้างระบบสื่อสารโทรคมนาคมเป็นตัวกลางในการแลกเปลี่ยนข้อมูล มีการประยุกต์ใช้งานหลากหลายรูปแบบ อินเทอร์เน็ตเป็นทั้งเครือข่ายของคอมพิวเตอร์ และเครือข่ายของเครือข่าย เพราะอินเทอร์เน็ตประกอบด้วยเครือข่ายย่อยเป็นจำนวนมากต่อเชื่อมเข้าด้วยกัน ภายใต้มาตรฐานเดียวกันจนเป็นสังคมเครือข่ายขนาดใหญ่ สามารถติดต่อกันได้ง่ายรวดเร็วขึ้น เราสามารถพบปะเพื่อนฝูง เครือญาติ เพื่อน โดยอาจไร้ตัวตนของคนที่เราสื่อสาร เป็นนิยามของคำว่าติดต่อกัน เพื่อมิตรภาพที่ไร้พรมแดนทั่วโลก ไม่เลือกเชื้อชาติ ชนชาติ ศาสนา เพศ อายุ และการสื่อสาร อยู่ที่ไหนก็สามารถติดต่อสื่อสารกันได้ หากเรารู้จักกันจากเพื่อนของเพื่อน รวดเร็วฉับไว ทันต่อข่าวสารทั่วโลก ทำให้เรารู้ข่าวสารสิ่งต่างๆได้อย่างง่ายดาย สามารถนำไปใช้ศึกษาเรียนรู้ในชีวิตประจำวันได้เลย
นอกจากนี้ก็ยังมีการโจมตีในรูปแบบของการปลอมแปลงอีเมล์ (Email Spoofing) หรือที่เรียกกันว่าPhishing ได้ทำการสร้างเว็บไซต์ปลอม เพื่อหลอกลวงให้เหยื่อหรือผู้รับอีเมล์เปิดเผยข้อมูลทางด้านการเงินหรือข้อมูลส่วนบุคคลอื่นๆ เป็นต้นนอกจากนี้ก็ยังมีการโจมตีในรูปแบบของการปลอมแปลงอีเมล์ (Email Spoofing) หรือที่เรียกกันว่าPhishing ได้ทำการสร้างเว็บไซต์ปลอม เพื่อหลอกลวงให้เหยื่อหรือผู้รับอีเมล์เปิดเผยข้อมูลทางด้านการเงินหรือข้อมูลส่วนบุคคลอื่นๆ เป็นต้น และยังได้มีช่องทางอื่นๆ ที่ทำให้การเจาะเข้ามาทำลายข้อมูลได้โดยง่ายจากหลายช่องทาง เช่น Wi-Fi ซึ่งคือ แอกเซสพล้อยภายในอาคารที่อำนวยความสะดวกสบายให้กับชีวิตประจำวัน โดยการติดตั้งระบบต่างๆต้องคำนึงถึงเวลาการติดตั้ง ไม่งั้นจะมีคนเข้ามาใช้และเข้ามาเอาข้อมูลของเราได้ จนอาจทำให้ระบบพังได้ภัยจากการล่อลวงทางอินเตอร์เน็ต มักลงเอยด้วยการล่อลวงคู่สนทนาเพื่อพาไปข่มขืน ซึ่งช่วงเวลา หนึ่งที่ผ่านมาการกระทำความผิดอาญา อันเกิดจากการล่อลวงทางอินเตอร์เน็ตนี้จะมีมาก สังเกตได้จากข่าว ในหน้าหนังสือพิมพ์หลายครั้งหลายคราวในช่วงเวลาที่ผ่านมา การใช้กฎหมายเพื่อเข้ามาแก้ไขปัญหาการล่อลวงทางอินเตอร์เน็ต จะสามารถทำได้มากน้อยแค่ไหนนั้น เป็นประเด็นที่ประสงค์จะแลก เปลี่ยนทัศนคติกับผู้อ่านและสังคม เพื่อที่คนทุกเพศ จะได้ตระหนักถึงภัยร้ายของสังคมในลักษณะเช่นนี้ จากสถิติการข่มขืนเพียงช่วงระยะเวลา 8 ปี ระหว่างปี 2540 - 2547 มีจำนวนคดีที่มากถึง 5,052 คดี อ้างอิงสถิติจากสำนักงานตำรวจแห่ง ชาติ ซึ่งโดยเฉลี่ยแล้วตามรายงาน ดังกล่าวช่วงอายุของเหยื่อจะอยู่ระหว่าง 20-30 ปี (อ้างอิงจากหนังสือพิมพ์ข่าวสด ฉบับวันที่ 25 พฤษภาคม 2548 หน้า 14) ซึ่งสถิติการล่อลวงทางอินเตอร์เน็ตเพื่อไปข่มขืนก็น่าที่จะถูกนำมารวมเป็นตัวเลขสถิติการกระทำผิดในลักษณะที่กล่าวมานี้ด้วย
ในส่วนของกฎหมายที่น่าจะนำมาใช้ลงโทษแก่ผู้กระทำผิดที่เข้ามาล่อลวงผู้เสียหายทางอินเตอร์เน็ต เพื่อไปข่มขืนกระทำชำเรา จะขอกล่าว ถึงเพียงเฉพาะตามประมวลกฎหมาย อาญา ลักษณะ 9 ความผิดเกี่ยวกับเพศจะแบ่งออกเป็น 6 ฐานใหญ่ๆ คือ
1) ความผิดฐานข่มขืนกระทำชำเรา
2) ความผิดฐานกระทำอนาจาร
3) ความผิดฐานเป็นธุระจัดหา ล่อไป หรือชักพาไปเพื่อการอนาจาร ซึ่งเด็กหญิงหรือหญิง
4) ความผิดฐานพาหญิงไปเพื่อการอนาจาร
5) ความผิดฐานดำรงชีพจากรายได้ของหญิงซึ่งค้าประเวณี
6) ความผิดฐานค้า หรือทำให้แพร่หลาย ซึ่งวัตถุหรือสิ่งของลามก

7) ความผิดฐานสำคัญที่สามารถนำมาปรับใช้กับการกระทำผิดกรณีล่อลวงทางอินเตอร์เน็ต น่าจะอยู่ที่ข้อ 1 และ 2 โดยที่ความผิดฐานข่มขืนกระทำชำเรา อาจแบ่งออกได้เป็น 2 ลักษณะ คือ ความผิดฐานข่มขืนกระทำชำเราหญิงซึ่งมิใช่ภริยาของตน กับความผิดฐานข่มขืนกระทำชำเราเด็กหญิงอายุยังไม่เกิน 15 ปี
