1. บุคคลที่ต้องโทษประหารชีวิตจะต้อง

1. บุคคลที่ต้องโทษประหารชีวิตจะต้องมีสิทธิอุทธรณ์ต่อศาลสูง และมีสิทธิเสนอฎีกาขออภัยโทษหรือลดโทษ

2. จะต้องไม่จัดการประหารชีวิตผู้ต้องโทษจนกว่ากระบวนการอุทธรณ์หรือยื่นฎีกาเพื่อขออภัยโทษหรือลดโทษนั้นเสร็จสิ้นลงแล้ว
