ตามทื่ ร.ต.เคล้า อินทร์แก้ว ได้ทำสัญญาเช่าที่ดิน น.ส.3 ก เลขที่ 9 เล่ม 1 ก หน้า 9 เลขที่ดิน 5 ตำบลแม่น้ำ อำเภอเสมุย จังหวัดสุราษฎร์ธานี ในฐานะผู้ให้เช่า กับ บริษัท เฮลโกมอนด์ จำกัด ในฐานะผู้เช่า มีกำหนด ระยะเวลาการเช่า 30 ปี นับตั้งแต่วันที่ 1 เมษายน 2548 จนถึงวันที่ 31 มีนาคม 2578 โดยมีรอบการชำระค่าเช่าใน 10 ปีแรก ผู้เช่าได้ชำระค่าเช่าเรียบร้อยแล้ว ภายในวันที่ 11 มีนาคม 2548 และตามสัญญาเช่า มีกำหนดชำระค่าเช่าในส่วนของปีที่ 11ถึงปีที่ 20 ภายในวันที่ 31 มีนาคม 2558 ซึ่งบัดนี้ใกล้จะถึงกำหนดเวลาดังกล่าวแล้ว
ปรากฏว่า ร.ต.เคล้า อินทร์แก้ว ได้เสียชีวิต เมื่อวันที่ 23 กรกฎาคม 2551 รายละเอียดปรากฏตามสำเนาทะเบียนราษฎร์ ซึ่งผู้เช่า ไม่สามารถจะหยั่งรู้ถึงสิทธิของผู้ให้เช่า ว่าบุคคลใดเป็นผู้มีสิทธิรับชำระค่าเช่าตามสัญญาในส่วนนี้ได้ทั้งในส่วนของผู้จัดการมรดก หรือทายาทตามพินัยกรรม โดยมิได้เป็นความผิดของผู้ให้เช่า เพื่อมิให้ฝ่ายผู้เช่าเป็นฝ่ายผิดสัญญาในการชำระค่าเช่าตามกำหนดเวลาตามสัญญา ผู้เช่ามีความจำเป็นจะต้องชำระค่าเช่าโดยใช้วิธีการวางทรัพย์ เป็นแคชเชียร์เช็ค เป็นจำนวนเงิน 3,360,000(สามล้านสามแสนหกหมื่นบาท)โดยสั่งจ่ายต่อกรมบังคับคดี เกาะสมุย ตั้งแต่วันที่.............เดือน.............พ.ศ................
ดังนั้นทางผู้เช่าขอให้ทายาท ผู้มีชื่อตามสำเนาทะเบียนราษฎร์หรือทายาทผู้สิทธิที่จะรับชำระค่าเช่าตามสัญญาดังกล่าว ได้ดำเนินการตามกฎหมายและนำหลักฐานการแสดงตน เพื่อเข้ารับเงินที่ผู้เช่าได้ชำระตามสัญญาเช่าดังกล่าวด้วย
