ต่อมาคณะรัฐมนตรี ได้มีมติเมื่อวันที่ 31 พฤษภาคม 2537 ให้ กฟผ. และสำนักงานคณะกรรมการนโยบายพลังงานแห่งชาติ (สพช.) ร่วมกันร่างประกาศรับซื้อไฟฟ้าจากผู้ผลิตไฟฟ้าอิสระ ตามนโยบายของรัฐบาล ซึ่ง กฟผ. ได้ออกประกาศรับซื้อไฟฟ้าจาก IPP เมื่อวันที่ 15 ธันวาคม 2537 มีการแต่งตั้งคณะอนุกรรมการประเมินและคัดเลือกข้อเสนอการรับซื้อไฟฟ้าจากผู้ผลิตไฟฟ้าเอกชนเมื่อ 23 มกราคม 2538 โดยมีผู้ว่าการการไฟฟ้าฝ่ายผลิตแห่งประเทศไทยเป็นประธาน ผู้แทน สพช. ผู้แทนสำนักงานคณะกรรมการพัฒนาการเศรษฐกิจและสังคมแห่งชาติ และผู้แทนสำนักงานเศรษฐกิจการคลังเป็นกรรมการ และเมื่อปิดรับข้อเสนอเมื่อวันที่ 30 มิถุนายน 2538 มีผู้ผลิตไฟฟ้าเอกชนยื่นข้อเสนอทั้งสิ้น 32 ราย รวม 50 โครงการ
