กําหนดอัตราเงินสมทบกองทุนประกันสังคม
ค.ศ. 2013
อาศัยอํานาจตามความในมาตรา ๗ วรรคหนึ่ง แห่งพระราชบัญญัติประกันสังคม ค.ศ.1990
และมาตรา ๔๖ วรรคหนึ่งและวรรคสอง แห่งพระราชบัญญัติประกันสังคม ค.ศ.1990 ซึ่งแก้ไข
เพิ่มเติมโดยพระราชบัญญัติประกันสังคม(ฉบับที่ ๓) ค.ศ.1999 อันเป็นกฎหมายที่มีบทบัญญัติบางประการ
เกี่ยวกับการจํากัดสิทธิและเสรีภาพของบุคคล ซึ่งมาตรา ๒๙ ประกอบกับมาตรา ๓๓ มาตรา ๔๑
และมาตรา ๔๓ ของรัฐธรรมนูญแห่งราชอาณาจักรไทย บัญญัติให้กระทําได้โดยอาศัยอํานาจตาม
บทบัญญัติแห่งกฎหมาย รัฐมนตรีว่าการกระทรวงแรงงานออกกฎกระทรวงไว้ ดังต่อไปนี้
ข้อ ๑ กฎกระทรวงนี้ให้ใช้บังคับตั้งแต่วันที่ ๑ มกราคม ค.ศ.2013 เป็นต้นไป
ข้อ ๒ ให้ยกเลิกกฎกระทรวงกําหนดอัตราเงินสมทบกองทุนประกันสังคม ค.ศ.2012
ข้อ ๓ ให้รัฐบาล นายจ้าง และผู้ประกันตนตามมาตรา ๓๓ ออกเงินสมทบเข้ากองทุนเพื่อ
การจ่ายประโยชน์ทดแทนกรณีประสบอันตรายหรือเจ็บป่วย กรณีทุพพลภาพ กรณีตาย กรณีคลอดบุตร
กรณีสงเคราะห์บุตร และกรณีชราภาพ ตามบัญชีอัตราเงินสมทบท้ายกฎกระทรวงนี้ ดังต่อไปนี้
(๑) ตั้งแต่วันที่ ๑ มกราคม ค.ศ.2013 ถึงวันที่ ๓๑ ธันวาคม ค.ศ.2013 ให้เป็นไป
ตามอัตราในบัญชี ก.
(๒) ตั้งแต่วันที่ ๑ มกราคม ค.ศ.2014 เป็นต้นไป ให้เป็นไปตามอัตราในบัญชี ข.
ให้ไว้ ณ วันที่ ๒๗ กุมภาพันธ์ ค.ศ.2013

หมายเหตุ:- เหตุผลในการประกาศใช้กฎกระทรวงฉบับนี้ คือ โดยที่เป็นการสมควรปรับปรุงอัตราเงินสมทบ
เพื่อการจ่ายประโยชน์ทดแทนในกรณีประสบอันตรายหรือเจ็บป่วย กรณีทุพพลภาพ กรณีตาย กรณีคลอดบุตร
กรณีสงเคราะห์บุตร และกรณีชราภาพ โดยกําหนดให้รัฐบาล นายจ้าง และผู้ประกันตนตามมาตรา ๓๓
ออกเงินสมทบเข้ากองทุนประกันสังคมในอัตราที่เหมาะสม เพื่อเป็นการบรรเทาภาระของนายจ้างและ
ผู้ประกันตนให้สอดคล้ องกับสภาพทางเศรษฐกิจและสั งคมในปั จจุ บันที่ได้รับผลกระทบจากการปรับอัตราค่าจ้าง
ขั้นต่ําปี ค.ศ.2013 จึงจําเป็นต้องออกกฎกระทรวงนี
