จากการที่รัฐธรรมนูญมีการกำหนดให้มีการแบ่งแยกอำนาจทั้ง 3 ฝ่ายเป็นอิสระต่อกัน คือ ฝ่ายนิติบัญญัติ ฝ่ายบริหาร และฝ่ายตุลาการ แต่รัฐธรรมนูญก็ได้บัญญัติให้อำนาจทั้ง 3 มีความสัมพันธ์ต่อกันด้วย เป็นการแสดงให้เห็นถึงระบบของการตรวจสอบและการถ่วงดุลอำนาจของทั้ง 3 ฝ่าย
โดยแต่ละฝ่ายสามารถถือสิทธิ และปกป้องสิทธิของตนเอง โดยการยับยั้ง และสนับสนุนในกิจกรรมสำคัญๆ ของอีกฝ่ายหนึ่งได้ ซึ่งในทางปฏิบัติผู้ร่างรัฐธรรมนูญมิได้ให้รัฐบาลกลางสหรัฐอเมริกามีการแบ่งแยกอำนาจออกจากกันโดยเด็ดขาด แต่เป็นการแบ่งแยกหน้าที่โดยใช้อำนาจร่วมกันจึงกล่าวได้ว่าหลักการถ่วงดุลอำนาจนี้ มีผลช่วยให้การปฏิบัติหน้าที่ตามอำนาจที่ได้รับมอบหมายจากรัฐธรรมนูญของหน่วยงานทั้งสามเป็นไปได้โดยสะดวก และป้องกันการเป็นเผด็จการในการใช้อำนาจของฝ่ายใดฝ่ายหนึ่ง
