รัฐธรรมนูญ คือกฎหมายสูงสุดในการปกครองประเทศ หรือที่เรานิยมเรียกกันว่า “กฎหมายแม่” นั่นเอง ปัจจุบันประเทศไทยใช้รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2540 รัฐธรรมนูญฉบับนี้ ถือกันว่าเป็นรัฐธรรมนูญที่ให้สิทธิเสรีภาพแก่ประชาชนมากที่สุดเท่าที่เคยมีมา ซึ่งรวมทั้งได้ให้สิทธิเสรีภาพของสื่อมวลชนในฐานะประชาชนคนหนึ่งด้วย โดยมีสาระสำคัญที่ให้ความคุ้มครองและเกี่ยวข้องกับการให้สิทธิเสรีภาพของประชาชนไว้หลายมาตราในหมวดต่าง ๆ โดยเฉพาะหมวด 3 ว่าด้วยเรื่องสิทธิและเสรีภาพของชนชาวไทย สำหรับมาตราสำคัญ ๆ ที่เกี่ยวข้องกับการประกอบวิชาชีพของผู้สื่อข่าวในฐานะประชาชนคนหนึ่งของประเทศ มีดังนี้
