2.3 การจัดเขตปลอดบุหรี่ และเขตสูบบุหรี่ เมื่อได้ประกาศกาหนดสถานที่สาธารณะที่ต้องจัดให้มีการคุ้มครองสุขภาพของผู้ไม่สูบบุหรี่แล้ว เจ้าของสถานที่มีหน้าที่ตามนัยมาตรา 5 แห่งพระราชบัญญัติคุ้มครองสุขภาพของ ผู้ไม่สูบบุหรี่ พ.ศ. 2535 ดังนี้
1) จัดส่วนหนึ่งส่วนใดหรือทั้งหมดของสถานที่สาธารณะเป็นเขตสูบบุหรี่และเขตปลอดบุหรี่
2) จัดเขตสูบบุหรี่และเขตปลอดบุหรี่ให้มีสภาพ ลักษณะและมาตรฐานตามที่กำหนด คือ
(1) เขตสูบบุหรี่ ต้องไม่อยู่ในบริเวณที่ก่อให้เกิดความเดือดร้อนรำคาญแก่ประชาชนที่อยู่บริเวณข้างเคียง ไม่อยู่ในบริเวณทางเข้า - ออกของสถานที่ที่ให้มีการคุ้มครองสุขภาพของผู้ไม่สูบบุหรี่ และไม่อยู่ในบริเวณที่เปิดเผยอันเป็นที่เห็นได้ชัดแก่ผู้มาใช้สถานที่นั้น หากเป็นบริเวณที่มีระบบปรับอากาศต้องมีการระบายอากาศถ่ายเทหมุนเวียนระหว่างภายนอกอาคารและภายในเขตสูบบุหรี่ ไม่น้อยกว่า 50 ลูกบาศก์ฟุต/นาที/คน (ตามประกาศกระทรวงสาธารณสุข (ฉบับที่ 9) พ.ศ. 2550)

(3) จัดให้มีเครื่องหมายในเขตสูบบุหรี่หรือเขตปลอดบุหรี่ ตามประกาศกระทรวงสาธารณสุข เรื่อง หลักเกณฑ์และวิธีการในการแสดงเครื่องหมายของเขตสูบบุหรี่และเขตปลอดบุหรี่ พ.ศ. 2551 สรุปได้ดังนี้
