การศึกษาในครั้งนี้ได้นําแนวคิดสิทธิมนุษยชน การให้ความคุ้มครองระหว่างประเทศแก่ผู้ลี้ภัย ซึ่งเป็นหลักคิดสากลในการให้ความคุ้มครองผู้ลี้ภัย หลักการห้ามผลักดันกลับไปสู่อันตราย (Nonrefoulement PrincipLe) รวมทั้งหลักการสิทธิมนุษยชนอื่นๆที่ปรากฏในกฎหมายระหว่างประเทศ กติกาและอนุสัญญาที่ประเทศไทยเข้าเป็นภาคี มาเป็นแนวทางในการศึกษา
ในฐานะที่ประเทศไทยได้เข้าเป็นภาคีกติกาและอนุสัญญาระหว่างประเทศ ประเทศไทยมี พันธกรณีที่จะต้องปฏิบัติตามกติกาและอนุสัญญา โดยคํานึงถึงปฏิญญาสากลว่าด้วยสิทธิมนุษยชน หากประเทศไทยมิได้ปฏิบัติตามอาจต้องรับผิดในทางระหว่างประเทศ อาทิ การถูกตัดหรือลดระดับ ความสัมพันธ์ทางการทูต การคว่ําบาตรทางเศรษฐกิจ เป็นต้น
