According to patent law of most countries, to be patentable, the industrial design must have novelty or originality. The consideration of novelty and originality varies from country to country.

In general, a design is not new if it:
Ø has been registered;
Ø has been published anywhere in the world, in respect of the same or any other article; or
Ø differs only in immaterial details, or features, from other designs that are commonly found in trade.

Hence, the applications that were published and were granted design patents did not regard as new and ineligible to be filed in other countries.

The deadline to file abovementioned two design applications (with claiming priority date) is 6 months from the first filing date which falls on October 28, 2016.
